中共中央 國務院關于構建和諧勞動關系的意見

為全面(mian)貫徹黨的(de)十八大和(he)(he)十八屆(jie)二中(zhong)、三中(zhong)、四中(zhong)全會精(jing)神,構建和(he)(he)諧(xie)(xie)勞(lao)動(dong)(dong)關系,推(tui)動(dong)(dong)科學發展(zhan),促進社會和(he)(he)諧(xie)(xie),現提出(chu)如下意見。

一、充分認識構建和諧勞動(dong)關系的重大意義

勞動(dong)關(guan)(guan)系(xi)(xi)(xi)(xi)(xi)(xi)是(shi)生產關(guan)(guan)系(xi)(xi)(xi)(xi)(xi)(xi)的(de)重(zhong)要(yao)組成(cheng)部(bu)分,是(shi)最基本、最重(zhong)要(yao)的(de)社(she)會關(guan)(guan)系(xi)(xi)(xi)(xi)(xi)(xi)之一(yi)(yi)。勞動(dong)關(guan)(guan)系(xi)(xi)(xi)(xi)(xi)(xi)是(shi)否和(he)(he)(he)諧,事關(guan)(guan)廣大職(zhi)工(gong)(gong)(gong)和(he)(he)(he)企業(ye)的(de)切身(shen)利(li)益(yi)(yi),事關(guan)(guan)經(jing)濟(ji)發展與社(she)會和(he)(he)(he)諧。黨和(he)(he)(he)國家歷(li)來(lai)高度重(zhong)視(shi)構建和(he)(he)(he)諧勞動(dong)關(guan)(guan)系(xi)(xi)(xi)(xi)(xi)(xi),制定了一(yi)(yi)系(xi)(xi)(xi)(xi)(xi)(xi)列法(fa)律法(fa)規和(he)(he)(he)政策(ce)措(cuo)施并作出工(gong)(gong)(gong)作部(bu)署。各(ge)級黨委(wei)和(he)(he)(he)政府認(ren)真(zhen)貫徹落(luo)實(shi)黨中央和(he)(he)(he)國務院(yuan)的(de)決策(ce)部(bu)署,取得了積極成(cheng)效,總體保持了全(quan)國勞動(dong)關(guan)(guan)系(xi)(xi)(xi)(xi)(xi)(xi)和(he)(he)(he)諧穩(wen)定。但是(shi),我國正處于經(jing)濟(ji)社(she)會轉型時期,勞動(dong)關(guan)(guan)系(xi)(xi)(xi)(xi)(xi)(xi)的(de)主體及(ji)其利(li)益(yi)(yi)訴求越(yue)來(lai)越(yue)多(duo)元化,勞動(dong)關(guan)(guan)系(xi)(xi)(xi)(xi)(xi)(xi)矛盾已進(jin)入凸(tu)顯(xian)期和(he)(he)(he)多(duo)發期,勞動(dong)爭(zheng)議案件居高不下,有(you)的(de)地方拖欠農民工(gong)(gong)(gong)工(gong)(gong)(gong)資等(deng)損(sun)害職(zhi)工(gong)(gong)(gong)利(li)益(yi)(yi)的(de)現象仍較突出,集體停(ting)工(gong)(gong)(gong)和(he)(he)(he)群(qun)體性(xing)事件時有(you)發生,構建和(he)(he)(he)諧勞動(dong)關(guan)(guan)系(xi)(xi)(xi)(xi)(xi)(xi)的(de)任務艱巨繁重(zhong)。

黨的(de)(de)十八大(da)明(ming)確提出構(gou)建和(he)(he)(he)諧(xie)(xie)勞(lao)動關(guan)(guan)系(xi)。在新的(de)(de)歷史條件下(xia),努力構(gou)建中(zhong)國特色和(he)(he)(he)諧(xie)(xie)勞(lao)動關(guan)(guan)系(xi),是加強和(he)(he)(he)創新社會(hui)(hui)管(guan)理(li)、保(bao)障和(he)(he)(he)改善(shan)民生(sheng)的(de)(de)重要(yao)(yao)(yao)內容(rong),是建設社會(hui)(hui)主(zhu)義(yi)和(he)(he)(he)諧(xie)(xie)社會(hui)(hui)的(de)(de)重要(yao)(yao)(yao)基(ji)礎,是經濟持(chi)續健(jian)康發(fa)展(zhan)的(de)(de)重要(yao)(yao)(yao)保(bao)證,是增強黨的(de)(de)執政(zheng)基(ji)礎、鞏固黨的(de)(de)執政(zheng)地位(wei)(wei)的(de)(de)必然要(yao)(yao)(yao)求。各級黨委和(he)(he)(he)政(zheng)府要(yao)(yao)(yao)從奪取中(zhong)國特色社會(hui)(hui)主(zhu)義(yi)新勝(sheng)利(li)的(de)(de)全局和(he)(he)(he)戰略高度,深刻認識構(gou)建和(he)(he)(he)諧(xie)(xie)勞(lao)動關(guan)(guan)系(xi)的(de)(de)重大(da)意義(yi),切實增強責任感(gan)和(he)(he)(he)使命感(gan),把構(gou)建和(he)(he)(he)諧(xie)(xie)勞(lao)動關(guan)(guan)系(xi)作為(wei)一項(xiang)緊迫任務,擺在更加突(tu)出的(de)(de)位(wei)(wei)置,采取有力措施抓實抓好。

二、構建和諧勞動關系的指導思想、工作原則和目標(biao)任務(wu)

(一)指導(dao)(dao)思想(xiang)。全面貫徹黨(dang)的(de)十(shi)八大(da)(da)(da)和(he)(he)(he)十(shi)八屆二中、三中、四中全會(hui)精神,以鄧(deng)小平理論、“三個代表”重要思想(xiang)、科學發展(zhan)(zhan)觀為指導(dao)(dao),深入貫徹習近平總書記系列重要講話精神,貫徹落實黨(dang)中央(yang)和(he)(he)(he)國務(wu)院的(de)決策部署,堅持促(cu)進(jin)企(qi)業發展(zhan)(zhan)、維護職(zhi)工權益,堅持正確處理改革發展(zhan)(zhan)穩定關系,推動中國特色和(he)(he)(he)諧勞(lao)(lao)動關系的(de)建設和(he)(he)(he)發展(zhan)(zhan),最大(da)(da)(da)限度增加勞(lao)(lao)動關系和(he)(he)(he)諧因(yin)素,最大(da)(da)(da)限度減少不和(he)(he)(he)諧因(yin)素,促(cu)進(jin)經濟持續健(jian)康發展(zhan)(zhan)和(he)(he)(he)社(she)會(hui)和(he)(he)(he)諧穩定,凝聚廣大(da)(da)(da)職(zhi)工為實現“兩個一百年(nian)”奮(fen)斗目標、實現中華民族偉大(da)(da)(da)復興的(de)中國夢貢獻力量(liang)。

(二)工作原則

——堅持以人(ren)為(wei)(wei)本(ben)(ben)。把解決廣大職工最關心、最直接、最現實(shi)(shi)的利益問題(ti),切實(shi)(shi)維護(hu)其根本(ben)(ben)權(quan)益,作為(wei)(wei)構建和諧勞(lao)動關系的根本(ben)(ben)出發點和落腳點。

——堅(jian)持依(yi)(yi)法(fa)(fa)構建(jian)。健(jian)全勞(lao)(lao)動(dong)保障法(fa)(fa)律法(fa)(fa)規(gui),增強(qiang)企業(ye)依(yi)(yi)法(fa)(fa)用工(gong)意(yi)識,提高職工(gong)依(yi)(yi)法(fa)(fa)維權能力(li),加強(qiang)勞(lao)(lao)動(dong)保障執法(fa)(fa)監督(du)和勞(lao)(lao)動(dong)糾紛(fen)調處(chu),依(yi)(yi)法(fa)(fa)處(chu)理勞(lao)(lao)動(dong)關(guan)系矛盾(dun),把勞(lao)(lao)動(dong)關(guan)系的建(jian)立、運行(xing)、監督(du)、調處(chu)的全過程(cheng)納入法(fa)(fa)治化軌(gui)道(dao)。

——堅持共(gong)建共(gong)享。統籌處理好(hao)促進企(qi)業發展和(he)維護(hu)職(zhi)工權益的關系,調動(dong)勞動(dong)關系主體雙方的積極性、主動(dong)性,推動(dong)企(qi)業和(he)職(zhi)工協商共(gong)事(shi)、機(ji)制共(gong)建、效益共(gong)創、利益共(gong)享。

——堅持改(gai)革創(chuang)新(xin)。從我國(guo)基本(ben)經濟(ji)制度(du)(du)出(chu)發,統(tong)籌考(kao)慮公有制經濟(ji)、非公有制經濟(ji)和混合所有制經濟(ji)的(de)(de)特(te)點(dian),不斷探究和把握社會主義市場經濟(ji)條(tiao)件下勞動關系的(de)(de)規律性,積極穩妥推(tui)進具有中國(guo)特(te)色的(de)(de)勞動關系工作理論、體制、制度(du)(du)、機制和方法創(chuang)新(xin)。

(三)目標任務。加(jia)(jia)強(qiang)調整勞(lao)(lao)(lao)(lao)動關(guan)(guan)系(xi)的(de)(de)(de)法律、體制(zhi)、制(zhi)度(du)、機制(zhi)和能(neng)力(li)建(jian)設,加(jia)(jia)快健全黨委領導、政府負責、社會協同、企業和職(zhi)工參與(yu)、法治(zhi)保障的(de)(de)(de)工作(zuo)體制(zhi),加(jia)(jia)快形成源(yuan)頭治(zhi)理(li)、動態管(guan)理(li)、應急(ji)處置相結合(he)的(de)(de)(de)工作(zuo)機制(zhi),實(shi)現勞(lao)(lao)(lao)(lao)動用工更加(jia)(jia)規(gui)范,職(zhi)工工資合(he)理(li)增長(chang),勞(lao)(lao)(lao)(lao)動條件(jian)不(bu)斷(duan)改善,職(zhi)工安全健康得到切實(shi)保障,社會保險全面覆(fu)蓋,人文關(guan)(guan)懷日(ri)益加(jia)(jia)強(qiang),有(you)效(xiao)預防(fang)和化解勞(lao)(lao)(lao)(lao)動關(guan)(guan)系(xi)矛盾,建(jian)立規(gui)范有(you)序、公正合(he)理(li)、互(hu)利共贏、和諧穩(wen)定的(de)(de)(de)勞(lao)(lao)(lao)(lao)動關(guan)(guan)系(xi)。

三、依法保障職工基本權益(yi)

(四(si))切實保(bao)障職工(gong)取得勞動報(bao)酬(chou)(chou)(chou)的權利。完(wan)善并落實工(gong)資支(zhi)付規定,健全工(gong)資支(zhi)付監控、工(gong)資保(bao)證金和欠薪應急周(zhou)轉金制度(du),探索建立欠薪保(bao)障金制度(du),落實清償(chang)欠薪的施工(gong)總承包企業負責制,依法懲處拒不支(zhi)付勞動報(bao)酬(chou)(chou)(chou)等違法犯罪行為,保(bao)障職工(gong)特別是農民(min)工(gong)按時(shi)足額領到(dao)工(gong)資報(bao)酬(chou)(chou)(chou)。努力實現農民(min)工(gong)與城鎮就業人員同工(gong)同酬(chou)(chou)(chou)。

(五(wu))切(qie)實(shi)保(bao)(bao)障職(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)休(xiu)息休(xiu)假的(de)權利(li)。完善并(bing)落實(shi)國(guo)家關于職(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)作(zuo)時間(jian)、全國(guo)年(nian)節及紀(ji)念日(ri)假期、帶(dai)薪年(nian)休(xiu)假等規(gui)定(ding)(ding)(ding)(ding),規(gui)范(fan)企(qi)業(ye)實(shi)行(xing)特殊工(gong)(gong)(gong)(gong)時制(zhi)度的(de)審批(pi)管理(li),督促企(qi)業(ye)依法安排(pai)職(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)休(xiu)息休(xiu)假。企(qi)業(ye)因生產經營(ying)需要安排(pai)職(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)延(yan)長工(gong)(gong)(gong)(gong)作(zuo)時間(jian)的(de),應與工(gong)(gong)(gong)(gong)會(hui)和職(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)協(xie)商,并(bing)依法足額(e)支付加班加點工(gong)(gong)(gong)(gong)資。加強勞(lao)動(dong)定(ding)(ding)(ding)(ding)額(e)定(ding)(ding)(ding)(ding)員(yuan)標(biao)準化(hua)工(gong)(gong)(gong)(gong)作(zuo),推(tui)動(dong)勞(lao)動(dong)定(ding)(ding)(ding)(ding)額(e)定(ding)(ding)(ding)(ding)員(yuan)國(guo)家標(biao)準、行(xing)業(ye)標(biao)準的(de)制(zhi)定(ding)(ding)(ding)(ding)修訂,指導企(qi)業(ye)制(zhi)定(ding)(ding)(ding)(ding)實(shi)施(shi)科學合理(li)的(de)勞(lao)動(dong)定(ding)(ding)(ding)(ding)額(e)定(ding)(ding)(ding)(ding)員(yuan)標(biao)準,保(bao)(bao)障職(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)的(de)休(xiu)息權利(li)。

(六)切實(shi)保(bao)障職(zhi)(zhi)(zhi)工(gong)獲得勞(lao)動(dong)安全(quan)衛生(sheng)(sheng)(sheng)(sheng)保(bao)護(hu)(hu)的(de)權利。加強勞(lao)動(dong)安全(quan)衛生(sheng)(sheng)(sheng)(sheng)執法監督(du),督(du)促企業健全(quan)并落實(shi)勞(lao)動(dong)安全(quan)衛生(sheng)(sheng)(sheng)(sheng)責任制(zhi),嚴格執行國(guo)家(jia)勞(lao)動(dong)安全(quan)衛生(sheng)(sheng)(sheng)(sheng)保(bao)護(hu)(hu)標準,加大(da)安全(quan)生(sheng)(sheng)(sheng)(sheng)產投入,強化安全(quan)生(sheng)(sheng)(sheng)(sheng)產和(he)職(zhi)(zhi)(zhi)業衛生(sheng)(sheng)(sheng)(sheng)教育培訓,提供符合國(guo)家(jia)規(gui)定的(de)勞(lao)動(dong)安全(quan)衛生(sheng)(sheng)(sheng)(sheng)條(tiao)件和(he)勞(lao)動(dong)保(bao)護(hu)(hu)用品(pin),對從(cong)事(shi)有(you)職(zhi)(zhi)(zhi)業危害作業的(de)職(zhi)(zhi)(zhi)工(gong)按照國(guo)家(jia)規(gui)定進(jin)行上(shang)崗(gang)(gang)前、在崗(gang)(gang)期間(jian)和(he)離崗(gang)(gang)時(shi)的(de)職(zhi)(zhi)(zhi)業健康(kang)檢查,加強女職(zhi)(zhi)(zhi)工(gong)和(he)未成年工(gong)特(te)殊勞(lao)動(dong)保(bao)護(hu)(hu),最大(da)限度地減(jian)少生(sheng)(sheng)(sheng)(sheng)產安全(quan)事(shi)故(gu)和(he)職(zhi)(zhi)(zhi)業病危害。

(七)切實(shi)(shi)保(bao)障職(zhi)(zhi)工享(xiang)受(shou)社(she)(she)會(hui)(hui)保(bao)險和(he)接(jie)(jie)受(shou)職(zhi)(zhi)業技(ji)(ji)能培(pei)訓(xun)的權(quan)利。認真貫徹實(shi)(shi)施社(she)(she)會(hui)(hui)保(bao)險法(fa),繼(ji)續(xu)完善社(she)(she)會(hui)(hui)保(bao)險關(guan)(guan)系轉移接(jie)(jie)續(xu)辦(ban)法(fa),努力實(shi)(shi)現(xian)社(she)(she)會(hui)(hui)保(bao)險全(quan)面覆蓋,落實(shi)(shi)廣大職(zhi)(zhi)工特別是農民工和(he)勞務(wu)派遣工的社(she)(she)會(hui)(hui)保(bao)險權(quan)益。督促(cu)企業依(yi)法(fa)為職(zhi)(zhi)工繳納各(ge)項社(she)(she)會(hui)(hui)保(bao)險費(fei),鼓(gu)(gu)勵(li)有條件的企業按照法(fa)律法(fa)規和(he)有關(guan)(guan)規定(ding)為職(zhi)(zhi)工建(jian)立(li)補充保(bao)險。引導(dao)職(zhi)(zhi)工自覺履行(xing)法(fa)定(ding)義務(wu),積極參加社(she)(she)會(hui)(hui)保(bao)險。加強(qiang)對職(zhi)(zhi)工的職(zhi)(zhi)業技(ji)(ji)能培(pei)訓(xun),鼓(gu)(gu)勵(li)職(zhi)(zhi)工參加學(xue)歷教育和(he)繼(ji)續(xu)教育,提高職(zhi)(zhi)工文化知識水平和(he)技(ji)(ji)能水平。

四、健全勞動(dong)關(guan)系協調機制(zhi)

(八)全(quan)面(mian)實(shi)行(xing)(xing)(xing)勞動(dong)合(he)同(tong)制(zhi)度(du)。貫徹落實(shi)好勞動(dong)合(he)同(tong)法(fa)(fa)等(deng)法(fa)(fa)律法(fa)(fa)規(gui),加強對企(qi)業實(shi)行(xing)(xing)(xing)勞動(dong)合(he)同(tong)制(zhi)度(du)的監督、指導(dao)和服務,在用工(gong)季節性強、職工(gong)流動(dong)性大的行(xing)(xing)(xing)業推廣簡(jian)易勞動(dong)合(he)同(tong)示(shi)范(fan)(fan)文本,依法(fa)(fa)規(gui)范(fan)(fan)勞動(dong)合(he)同(tong)訂立、履行(xing)(xing)(xing)、變更(geng)、解除(chu)、終止等(deng)行(xing)(xing)(xing)為(wei),切實(shi)提(ti)高(gao)勞動(dong)合(he)同(tong)簽訂率和履行(xing)(xing)(xing)質(zhi)量(liang)。依法(fa)(fa)加強對勞務派遣的監管(guan)(guan),規(gui)范(fan)(fan)非(fei)全(quan)日(ri)制(zhi)、勞務承攬、勞務外包用工(gong)和企(qi)業裁(cai)員行(xing)(xing)(xing)為(wei)。指導(dao)企(qi)業建立健全(quan)勞動(dong)規(gui)章制(zhi)度(du),提(ti)升勞動(dong)用工(gong)管(guan)(guan)理(li)水平。全(quan)面(mian)推進(jin)勞動(dong)用工(gong)信息申報備(bei)案制(zhi)度(du)建設,加強對企(qi)業勞動(dong)用工(gong)的動(dong)態管(guan)(guan)理(li)。

(九(jiu))推(tui)行(xing)(xing)集(ji)(ji)(ji)體(ti)協商和集(ji)(ji)(ji)體(ti)合(he)同制(zhi)度。以非公有(you)制(zhi)企(qi)業為(wei)重(zhong)點對象,依法推(tui)進(jin)工(gong)(gong)資(zi)(zi)集(ji)(ji)(ji)體(ti)協商,不斷擴(kuo)大覆蓋面、增強(qiang)實(shi)效性,形(xing)成反映人力(li)(li)資(zi)(zi)源(yuan)市場供(gong)求關系和企(qi)業經濟效益的(de)(de)工(gong)(gong)資(zi)(zi)決定(ding)機(ji)制(zhi)和正常增長機(ji)制(zhi)。完善工(gong)(gong)資(zi)(zi)指導線制(zhi)度,加(jia)快建立(li)統(tong)一規范的(de)(de)企(qi)業薪酬調查和信(xin)息發布制(zhi)度,為(wei)開(kai)展工(gong)(gong)資(zi)(zi)集(ji)(ji)(ji)體(ti)協商提供(gong)參考。推(tui)動企(qi)業與職(zhi)工(gong)(gong)就工(gong)(gong)作條件、勞動定(ding)額、女職(zhi)工(gong)(gong)特殊保護等開(kai)展集(ji)(ji)(ji)體(ti)協商,訂立(li)集(ji)(ji)(ji)體(ti)合(he)同。加(jia)強(qiang)集(ji)(ji)(ji)體(ti)協商代表能(neng)力(li)(li)建設,提高協商水(shui)平。加(jia)強(qiang)對集(ji)(ji)(ji)體(ti)協商過程的(de)(de)指導,督促企(qi)業和職(zhi)工(gong)(gong)認真(zhen)履行(xing)(xing)集(ji)(ji)(ji)體(ti)合(he)同。

(十)健全協(xie)調勞動關系三(san)(san)(san)(san)方(fang)(fang)(fang)機(ji)制(zhi)(zhi)(zhi)(zhi)。完善協(xie)調勞動關系三(san)(san)(san)(san)方(fang)(fang)(fang)機(ji)制(zhi)(zhi)(zhi)(zhi)組織(zhi)體(ti)系,建(jian)立(li)健全由人力資源社會(hui)(hui)保障(zhang)部(bu)門會(hui)(hui)同工(gong)會(hui)(hui)和(he)企(qi)業(ye)聯合(he)(he)會(hui)(hui)、工(gong)商業(ye)聯合(he)(he)會(hui)(hui)等(deng)企(qi)業(ye)代表(biao)組織(zhi)組成的(de)(de)三(san)(san)(san)(san)方(fang)(fang)(fang)機(ji)制(zhi)(zhi)(zhi)(zhi),根據(ju)實(shi)際需要推(tui)動工(gong)業(ye)園區(qu)、鄉鎮(街道)和(he)產業(ye)系統建(jian)立(li)三(san)(san)(san)(san)方(fang)(fang)(fang)機(ji)制(zhi)(zhi)(zhi)(zhi)。加強和(he)創新三(san)(san)(san)(san)方(fang)(fang)(fang)機(ji)制(zhi)(zhi)(zhi)(zhi)組織(zhi)建(jian)設,建(jian)立(li)健全協(xie)調勞動關系三(san)(san)(san)(san)方(fang)(fang)(fang)委員會(hui)(hui),由同級政府領導擔任委員會(hui)(hui)主(zhu)任。完善三(san)(san)(san)(san)方(fang)(fang)(fang)機(ji)制(zhi)(zhi)(zhi)(zhi)職(zhi)能,健全工(gong)作制(zhi)(zhi)(zhi)(zhi)度,充分發揮政府、工(gong)會(hui)(hui)和(he)企(qi)業(ye)代表(biao)組織(zhi)共同研究解決有關勞動關系重大問題的(de)(de)重要作用(yong)。

五(wu)、加強企(qi)業民主管理(li)制度建設(she)
