中共中央 國務院關于構建和諧勞動關系的意見

為(wei)全面貫徹黨的十八(ba)大和(he)十八(ba)屆二中(zhong)、三中(zhong)、四中(zhong)全會(hui)精神,構(gou)建和(he)諧勞動關系(xi),推(tui)動科學發展,促(cu)進社(she)會(hui)和(he)諧,現提出如(ru)下意見。

一、充分認識構建和(he)諧(xie)勞(lao)動關系的重(zhong)大意(yi)義(yi)

勞(lao)動(dong)關(guan)系(xi)(xi)(xi)(xi)(xi)是生產關(guan)系(xi)(xi)(xi)(xi)(xi)的(de)重(zhong)要組成(cheng)部分,是最基(ji)本(ben)、最重(zhong)要的(de)社(she)會(hui)關(guan)系(xi)(xi)(xi)(xi)(xi)之(zhi)一。勞(lao)動(dong)關(guan)系(xi)(xi)(xi)(xi)(xi)是否和(he)諧(xie)(xie),事關(guan)廣大職工和(he)企業的(de)切身利(li)益(yi)(yi),事關(guan)經濟(ji)發(fa)展(zhan)與(yu)社(she)會(hui)和(he)諧(xie)(xie)。黨和(he)國家歷來高(gao)度重(zhong)視構建和(he)諧(xie)(xie)勞(lao)動(dong)關(guan)系(xi)(xi)(xi)(xi)(xi),制定了一系(xi)(xi)(xi)(xi)(xi)列法律法規和(he)政策措(cuo)施并作出工作部署。各(ge)級黨委和(he)政府認真貫(guan)徹落實黨中(zhong)央和(he)國務院的(de)決(jue)策部署,取得(de)了積極成(cheng)效,總(zong)體保持了全國勞(lao)動(dong)關(guan)系(xi)(xi)(xi)(xi)(xi)和(he)諧(xie)(xie)穩定。但是,我國正(zheng)處于經濟(ji)社(she)會(hui)轉型時期(qi)(qi),勞(lao)動(dong)關(guan)系(xi)(xi)(xi)(xi)(xi)的(de)主體及(ji)其利(li)益(yi)(yi)訴求越(yue)來越(yue)多(duo)元化,勞(lao)動(dong)關(guan)系(xi)(xi)(xi)(xi)(xi)矛盾已進(jin)入(ru)凸(tu)顯期(qi)(qi)和(he)多(duo)發(fa)期(qi)(qi),勞(lao)動(dong)爭議案件居(ju)高(gao)不下,有(you)的(de)地(di)方(fang)拖欠農民工工資等損(sun)害職工利(li)益(yi)(yi)的(de)現象仍較突出,集體停工和(he)群體性事件時有(you)發(fa)生,構建和(he)諧(xie)(xie)勞(lao)動(dong)關(guan)系(xi)(xi)(xi)(xi)(xi)的(de)任務艱(jian)巨(ju)繁重(zhong)。

黨(dang)的(de)(de)(de)(de)十八大明(ming)確提出構(gou)(gou)(gou)建和(he)(he)諧(xie)(xie)勞(lao)動(dong)關(guan)系(xi)(xi)。在新的(de)(de)(de)(de)歷史(shi)條件下,努(nu)力構(gou)(gou)(gou)建中國(guo)特色(se)和(he)(he)諧(xie)(xie)勞(lao)動(dong)關(guan)系(xi)(xi),是(shi)(shi)加強和(he)(he)創新社(she)(she)會管理、保(bao)障和(he)(he)改善民生(sheng)的(de)(de)(de)(de)重要(yao)(yao)內容,是(shi)(shi)建設(she)社(she)(she)會主(zhu)(zhu)義和(he)(he)諧(xie)(xie)社(she)(she)會的(de)(de)(de)(de)重要(yao)(yao)基(ji)礎,是(shi)(shi)經(jing)濟(ji)持(chi)續健康發展的(de)(de)(de)(de)重要(yao)(yao)保(bao)證,是(shi)(shi)增(zeng)強黨(dang)的(de)(de)(de)(de)執政基(ji)礎、鞏固(gu)黨(dang)的(de)(de)(de)(de)執政地位的(de)(de)(de)(de)必然要(yao)(yao)求。各(ge)級黨(dang)委和(he)(he)政府(fu)要(yao)(yao)從奪取中國(guo)特色(se)社(she)(she)會主(zhu)(zhu)義新勝利的(de)(de)(de)(de)全(quan)局和(he)(he)戰略高度,深刻認(ren)識(shi)構(gou)(gou)(gou)建和(he)(he)諧(xie)(xie)勞(lao)動(dong)關(guan)系(xi)(xi)的(de)(de)(de)(de)重大意義,切實(shi)增(zeng)強責(ze)任感和(he)(he)使命感,把構(gou)(gou)(gou)建和(he)(he)諧(xie)(xie)勞(lao)動(dong)關(guan)系(xi)(xi)作(zuo)為一項緊(jin)迫任務,擺(bai)在更加突出的(de)(de)(de)(de)位置,采取有(you)力措施抓實(shi)抓好。

二、構(gou)建和(he)諧勞動關系的指導思想、工(gong)作(zuo)原(yuan)則(ze)和(he)目標任務

(一(yi))指導(dao)思想(xiang)。全(quan)面貫徹(che)黨(dang)的(de)(de)十八大和(he)十八屆二(er)中(zhong)、三中(zhong)、四中(zhong)全(quan)會精神,以鄧小平理論、“三個代表”重要思想(xiang)、科學發(fa)展(zhan)(zhan)觀為指導(dao),深(shen)入貫徹(che)習近平總(zong)書(shu)記系列重要講話(hua)精神,貫徹(che)落(luo)實黨(dang)中(zhong)央(yang)和(he)國(guo)務院的(de)(de)決策部(bu)署,堅持(chi)促進企業(ye)發(fa)展(zhan)(zhan)、維護職工(gong)權益(yi),堅持(chi)正確處理改(gai)革發(fa)展(zhan)(zhan)穩定關(guan)系,推動中(zhong)國(guo)特色和(he)諧勞動關(guan)系的(de)(de)建設和(he)發(fa)展(zhan)(zhan),最大限(xian)(xian)度增加(jia)勞動關(guan)系和(he)諧因素,最大限(xian)(xian)度減少不和(he)諧因素,促進經濟持(chi)續健康發(fa)展(zhan)(zhan)和(he)社會和(he)諧穩定,凝聚廣大職工(gong)為實現“兩個一(yi)百年”奮(fen)斗目標(biao)、實現中(zhong)華民族偉大復興的(de)(de)中(zhong)國(guo)夢貢獻力量。

(二)工作原則

——堅持(chi)以人為(wei)本(ben)。把(ba)解決廣(guang)大職工最關心(xin)、最直接、最現實(shi)(shi)的利益問題,切實(shi)(shi)維護(hu)其根本(ben)權益,作為(wei)構(gou)建和(he)諧勞(lao)動關系的根本(ben)出發(fa)點和(he)落腳點。

——堅持依法(fa)(fa)構(gou)建。健全勞(lao)動(dong)(dong)保障法(fa)(fa)律法(fa)(fa)規,增強企業依法(fa)(fa)用(yong)工(gong)(gong)意識(shi),提(ti)高職工(gong)(gong)依法(fa)(fa)維權能力,加強勞(lao)動(dong)(dong)保障執法(fa)(fa)監督(du)和勞(lao)動(dong)(dong)糾紛調處,依法(fa)(fa)處理勞(lao)動(dong)(dong)關(guan)(guan)系矛盾,把勞(lao)動(dong)(dong)關(guan)(guan)系的建立(li)、運(yun)行、監督(du)、調處的全過程(cheng)納(na)入法(fa)(fa)治化軌道。

——堅持共(gong)建共(gong)享。統籌處理好(hao)促進(jin)企業(ye)發展和維護職工權益(yi)的關(guan)系(xi),調動(dong)勞動(dong)關(guan)系(xi)主(zhu)體雙方的積極(ji)性(xing)、主(zhu)動(dong)性(xing),推動(dong)企業(ye)和職工協(xie)商共(gong)事、機制共(gong)建、效益(yi)共(gong)創、利益(yi)共(gong)享。

——堅(jian)持改革創(chuang)新(xin)。從我(wo)國(guo)基本經濟(ji)制(zhi)度出發,統籌考慮(lv)公(gong)有制(zhi)經濟(ji)、非公(gong)有制(zhi)經濟(ji)和混合所有制(zhi)經濟(ji)的特(te)點,不斷探究和把握社會主義市場(chang)經濟(ji)條件(jian)下(xia)勞動關系的規律性,積極(ji)穩妥推進具有中國(guo)特(te)色(se)的勞動關系工作(zuo)理論、體制(zhi)、制(zhi)度、機制(zhi)和方(fang)法(fa)創(chuang)新(xin)。

(三)目標任務。加(jia)(jia)強調整勞(lao)動(dong)(dong)關(guan)系(xi)的(de)(de)法律(lv)、體(ti)(ti)制、制度、機制和(he)(he)能(neng)力建設,加(jia)(jia)快健全黨委(wei)領導、政府負責、社會(hui)協同、企業和(he)(he)職(zhi)工(gong)參與、法治(zhi)保(bao)障的(de)(de)工(gong)作體(ti)(ti)制,加(jia)(jia)快形成源頭治(zhi)理(li)、動(dong)(dong)態管理(li)、應急處置相結(jie)合的(de)(de)工(gong)作機制,實(shi)現勞(lao)動(dong)(dong)用(yong)工(gong)更加(jia)(jia)規范,職(zhi)工(gong)工(gong)資合理(li)增長(chang),勞(lao)動(dong)(dong)條件(jian)不斷改善,職(zhi)工(gong)安全健康得到切實(shi)保(bao)障,社會(hui)保(bao)險(xian)全面覆(fu)蓋,人(ren)文關(guan)懷日益加(jia)(jia)強,有效預(yu)防和(he)(he)化解(jie)勞(lao)動(dong)(dong)關(guan)系(xi)矛盾,建立(li)規范有序、公正(zheng)合理(li)、互利共贏(ying)、和(he)(he)諧穩定的(de)(de)勞(lao)動(dong)(dong)關(guan)系(xi)。

三(san)、依法保障職工基本權益

(四(si))切實保障職工(gong)(gong)(gong)取得勞動報酬(chou)(chou)的權利。完善并落(luo)實工(gong)(gong)(gong)資支(zhi)(zhi)付規定,健(jian)全(quan)工(gong)(gong)(gong)資支(zhi)(zhi)付監控、工(gong)(gong)(gong)資保證(zheng)金(jin)(jin)和欠(qian)薪(xin)應急周轉金(jin)(jin)制度(du),探索建立欠(qian)薪(xin)保障金(jin)(jin)制度(du),落(luo)實清償(chang)欠(qian)薪(xin)的施工(gong)(gong)(gong)總承包企業(ye)負責制,依法懲處拒不支(zhi)(zhi)付勞動報酬(chou)(chou)等違(wei)法犯罪行為(wei),保障職工(gong)(gong)(gong)特別是農民工(gong)(gong)(gong)按時(shi)足(zu)額領到工(gong)(gong)(gong)資報酬(chou)(chou)。努力實現農民工(gong)(gong)(gong)與城(cheng)鎮(zhen)就業(ye)人(ren)員同工(gong)(gong)(gong)同酬(chou)(chou)。

(五(wu))切實保(bao)(bao)障(zhang)(zhang)職(zhi)(zhi)工(gong)(gong)(gong)休息休假(jia)的(de)權(quan)利(li)。完善并落實國家(jia)關(guan)于職(zhi)(zhi)工(gong)(gong)(gong)工(gong)(gong)(gong)作時間(jian)、全(quan)國年節(jie)及紀念日假(jia)期、帶(dai)薪年休假(jia)等(deng)規(gui)定(ding)(ding),規(gui)范企業(ye)(ye)實行特殊(shu)工(gong)(gong)(gong)時制度的(de)審批管理,督促企業(ye)(ye)依法(fa)安(an)排職(zhi)(zhi)工(gong)(gong)(gong)休息休假(jia)。企業(ye)(ye)因生(sheng)產(chan)經營需要(yao)安(an)排職(zhi)(zhi)工(gong)(gong)(gong)延長工(gong)(gong)(gong)作時間(jian)的(de),應與工(gong)(gong)(gong)會和職(zhi)(zhi)工(gong)(gong)(gong)協商,并依法(fa)足額(e)支(zhi)付加(jia)(jia)班加(jia)(jia)點工(gong)(gong)(gong)資。加(jia)(jia)強(qiang)勞(lao)動定(ding)(ding)額(e)定(ding)(ding)員(yuan)標(biao)(biao)準化工(gong)(gong)(gong)作,推(tui)動勞(lao)動定(ding)(ding)額(e)定(ding)(ding)員(yuan)國家(jia)標(biao)(biao)準、行業(ye)(ye)標(biao)(biao)準的(de)制定(ding)(ding)修訂,指導(dao)企業(ye)(ye)制定(ding)(ding)實施科學合理的(de)勞(lao)動定(ding)(ding)額(e)定(ding)(ding)員(yuan)標(biao)(biao)準,保(bao)(bao)障(zhang)(zhang)職(zhi)(zhi)工(gong)(gong)(gong)的(de)休息權(quan)利(li)。

(六)切實保(bao)障職工獲得勞(lao)(lao)動(dong)(dong)安(an)(an)全衛(wei)(wei)生(sheng)(sheng)(sheng)保(bao)護的權利。加強勞(lao)(lao)動(dong)(dong)安(an)(an)全衛(wei)(wei)生(sheng)(sheng)(sheng)執法(fa)監督,督促企業(ye)(ye)健(jian)全并落實勞(lao)(lao)動(dong)(dong)安(an)(an)全衛(wei)(wei)生(sheng)(sheng)(sheng)責任制,嚴格執行國(guo)家勞(lao)(lao)動(dong)(dong)安(an)(an)全衛(wei)(wei)生(sheng)(sheng)(sheng)保(bao)護標準,加大安(an)(an)全生(sheng)(sheng)(sheng)產投入,強化安(an)(an)全生(sheng)(sheng)(sheng)產和(he)職業(ye)(ye)衛(wei)(wei)生(sheng)(sheng)(sheng)教育培(pei)訓,提供(gong)符合國(guo)家規(gui)定的勞(lao)(lao)動(dong)(dong)安(an)(an)全衛(wei)(wei)生(sheng)(sheng)(sheng)條件(jian)和(he)勞(lao)(lao)動(dong)(dong)保(bao)護用品,對從事(shi)有職業(ye)(ye)危害作業(ye)(ye)的職工按照(zhao)國(guo)家規(gui)定進行上崗(gang)(gang)前、在崗(gang)(gang)期間和(he)離(li)崗(gang)(gang)時的職業(ye)(ye)健(jian)康檢查,加強女(nv)職工和(he)未成年工特殊勞(lao)(lao)動(dong)(dong)保(bao)護,最大限度地減少生(sheng)(sheng)(sheng)產安(an)(an)全事(shi)故和(he)職業(ye)(ye)病危害。

(七)切實(shi)(shi)保障(zhang)職(zhi)工(gong)(gong)(gong)享受(shou)社(she)(she)會(hui)(hui)(hui)保險(xian)(xian)(xian)和(he)(he)(he)接(jie)受(shou)職(zhi)業(ye)(ye)(ye)技能(neng)培訓的(de)權(quan)利。認(ren)真(zhen)貫徹實(shi)(shi)施社(she)(she)會(hui)(hui)(hui)保險(xian)(xian)(xian)法(fa)(fa),繼(ji)續完善社(she)(she)會(hui)(hui)(hui)保險(xian)(xian)(xian)關系轉移接(jie)續辦法(fa)(fa),努(nu)力實(shi)(shi)現(xian)社(she)(she)會(hui)(hui)(hui)保險(xian)(xian)(xian)全面覆蓋(gai),落實(shi)(shi)廣大職(zhi)工(gong)(gong)(gong)特別是農民(min)工(gong)(gong)(gong)和(he)(he)(he)勞(lao)務(wu)派遣工(gong)(gong)(gong)的(de)社(she)(she)會(hui)(hui)(hui)保險(xian)(xian)(xian)權(quan)益。督促(cu)企業(ye)(ye)(ye)依法(fa)(fa)為(wei)職(zhi)工(gong)(gong)(gong)繳(jiao)納(na)各(ge)項社(she)(she)會(hui)(hui)(hui)保險(xian)(xian)(xian)費,鼓勵(li)有條(tiao)件的(de)企業(ye)(ye)(ye)按照(zhao)法(fa)(fa)律(lv)法(fa)(fa)規(gui)和(he)(he)(he)有關規(gui)定為(wei)職(zhi)工(gong)(gong)(gong)建立補充(chong)保險(xian)(xian)(xian)。引(yin)導職(zhi)工(gong)(gong)(gong)自(zi)覺(jue)履行法(fa)(fa)定義務(wu),積(ji)極參加(jia)(jia)社(she)(she)會(hui)(hui)(hui)保險(xian)(xian)(xian)。加(jia)(jia)強對職(zhi)工(gong)(gong)(gong)的(de)職(zhi)業(ye)(ye)(ye)技能(neng)培訓,鼓勵(li)職(zhi)工(gong)(gong)(gong)參加(jia)(jia)學(xue)歷教(jiao)育(yu)(yu)和(he)(he)(he)繼(ji)續教(jiao)育(yu)(yu),提高職(zhi)工(gong)(gong)(gong)文化知識水(shui)平和(he)(he)(he)技能(neng)水(shui)平。

四、健(jian)全勞(lao)動關系協調(diao)機(ji)制(zhi)

(八)全面(mian)實(shi)行(xing)勞(lao)(lao)動(dong)(dong)合同(tong)制(zhi)(zhi)度(du)。貫徹落(luo)實(shi)好勞(lao)(lao)動(dong)(dong)合同(tong)法等(deng)法律法規,加(jia)(jia)強對企(qi)業(ye)實(shi)行(xing)勞(lao)(lao)動(dong)(dong)合同(tong)制(zhi)(zhi)度(du)的監督(du)、指(zhi)導(dao)和(he)服務,在用(yong)工(gong)季節性強、職工(gong)流動(dong)(dong)性大(da)的行(xing)業(ye)推(tui)廣簡易勞(lao)(lao)動(dong)(dong)合同(tong)示范文(wen)本,依法規范勞(lao)(lao)動(dong)(dong)合同(tong)訂(ding)立、履行(xing)、變更、解除(chu)、終止(zhi)等(deng)行(xing)為,切實(shi)提(ti)高勞(lao)(lao)動(dong)(dong)合同(tong)簽訂(ding)率和(he)履行(xing)質(zhi)量。依法加(jia)(jia)強對勞(lao)(lao)務派遣的監管(guan),規范非全日(ri)制(zhi)(zhi)、勞(lao)(lao)務承攬、勞(lao)(lao)務外包用(yong)工(gong)和(he)企(qi)業(ye)裁員行(xing)為。指(zhi)導(dao)企(qi)業(ye)建立健(jian)全勞(lao)(lao)動(dong)(dong)規章制(zhi)(zhi)度(du),提(ti)升勞(lao)(lao)動(dong)(dong)用(yong)工(gong)管(guan)理水平。全面(mian)推(tui)進勞(lao)(lao)動(dong)(dong)用(yong)工(gong)信息申報(bao)備案(an)制(zhi)(zhi)度(du)建設,加(jia)(jia)強對企(qi)業(ye)勞(lao)(lao)動(dong)(dong)用(yong)工(gong)的動(dong)(dong)態管(guan)理。

(九)推(tui)行集(ji)(ji)體(ti)協(xie)商(shang)(shang)和集(ji)(ji)體(ti)合(he)(he)同(tong)制(zhi)度(du)(du)。以非公有制(zhi)企業(ye)為重點對(dui)象(xiang),依法推(tui)進工(gong)(gong)資(zi)集(ji)(ji)體(ti)協(xie)商(shang)(shang),不斷擴大覆蓋面(mian)、增(zeng)強實效(xiao)性(xing),形成反映人力資(zi)源市場供求關系和企業(ye)經濟效(xiao)益的工(gong)(gong)資(zi)決定(ding)機制(zhi)和正常(chang)增(zeng)長(chang)機制(zhi)。完善(shan)工(gong)(gong)資(zi)指(zhi)導線制(zhi)度(du)(du),加(jia)(jia)快建(jian)立(li)統一規范的企業(ye)薪酬調查和信息發布制(zhi)度(du)(du),為開(kai)展工(gong)(gong)資(zi)集(ji)(ji)體(ti)協(xie)商(shang)(shang)提(ti)供參考。推(tui)動企業(ye)與職(zhi)工(gong)(gong)就工(gong)(gong)作(zuo)條件、勞動定(ding)額、女職(zhi)工(gong)(gong)特殊(shu)保護等開(kai)展集(ji)(ji)體(ti)協(xie)商(shang)(shang),訂立(li)集(ji)(ji)體(ti)合(he)(he)同(tong)。加(jia)(jia)強集(ji)(ji)體(ti)協(xie)商(shang)(shang)代表能(neng)力建(jian)設,提(ti)高(gao)協(xie)商(shang)(shang)水(shui)平。加(jia)(jia)強對(dui)集(ji)(ji)體(ti)協(xie)商(shang)(shang)過程的指(zhi)導,督促企業(ye)和職(zhi)工(gong)(gong)認真履行集(ji)(ji)體(ti)合(he)(he)同(tong)。

(十)健全(quan)協(xie)調勞動(dong)關(guan)系(xi)(xi)三(san)(san)方機(ji)(ji)(ji)制(zhi)(zhi)。完善協(xie)調勞動(dong)關(guan)系(xi)(xi)三(san)(san)方機(ji)(ji)(ji)制(zhi)(zhi)組織(zhi)體(ti)系(xi)(xi),建(jian)立(li)(li)健全(quan)由人力資源社會保(bao)障部門會同(tong)工會和(he)企(qi)業(ye)聯合(he)會、工商(shang)業(ye)聯合(he)會等(deng)企(qi)業(ye)代表(biao)組織(zhi)組成的(de)三(san)(san)方機(ji)(ji)(ji)制(zhi)(zhi),根據實際需要(yao)推動(dong)工業(ye)園區、鄉鎮(街(jie)道)和(he)產業(ye)系(xi)(xi)統建(jian)立(li)(li)三(san)(san)方機(ji)(ji)(ji)制(zhi)(zhi)。加強和(he)創新三(san)(san)方機(ji)(ji)(ji)制(zhi)(zhi)組織(zhi)建(jian)設(she),建(jian)立(li)(li)健全(quan)協(xie)調勞動(dong)關(guan)系(xi)(xi)三(san)(san)方委員(yuan)(yuan)會,由同(tong)級政府(fu)領導(dao)擔任(ren)委員(yuan)(yuan)會主任(ren)。完善三(san)(san)方機(ji)(ji)(ji)制(zhi)(zhi)職能,健全(quan)工作(zuo)(zuo)制(zhi)(zhi)度(du),充分發揮政府(fu)、工會和(he)企(qi)業(ye)代表(biao)組織(zhi)共(gong)同(tong)研究解(jie)決有關(guan)勞動(dong)關(guan)系(xi)(xi)重大問題的(de)重要(yao)作(zuo)(zuo)用。

五、加強(qiang)企業民(min)主(zhu)管理制度(du)建設

(十二)推(tui)進廠(chang)(chang)務公(gong)(gong)(gong)開(kai)(kai)制(zhi)度化、規范化。進一步提高廠(chang)(chang)務公(gong)(gong)(gong)開(kai)(kai)建制(zhi)率(lv),加強國有(you)(you)企業改制(zhi)重組過程中的(de)廠(chang)(chang)務公(gong)(gong)(gong)開(kai)(kai),積極穩(wen)妥推(tui)進非(fei)公(gong)(gong)(gong)有(you)(you)制(zhi)企業廠(chang)(chang)務公(gong)(gong)(gong)開(kai)(kai)制(zhi)度建設。完(wan)善公(gong)(gong)(gong)開(kai)(kai)程序,充(chong)實公(gong)(gong)(gong)開(kai)(kai)內容,創新公(gong)(gong)(gong)開(kai)(kai)形(xing)式(shi),探(tan)索和(he)推(tui)行(xing)經理接(jie)待日、勞(lao)資懇(ken)談(tan)會、總經理信箱等多種形(xing)式(shi)的(de)公(gong)(gong)(gong)開(kai)(kai)。

(十三)推行職(zhi)(zhi)(zhi)工(gong)(gong)(gong)董(dong)事(shi)、職(zhi)(zhi)(zhi)工(gong)(gong)(gong)監事(shi)制(zhi)度(du)。按照(zhao)公司法(fa)規(gui)定(ding),在公司制(zhi)企業建立(li)職(zhi)(zhi)(zhi)工(gong)(gong)(gong)董(dong)事(shi)、職(zhi)(zhi)(zhi)工(gong)(gong)(gong)監事(shi)制(zhi)度(du)。依法(fa)規(gui)范職(zhi)(zhi)(zhi)工(gong)(gong)(gong)董(dong)事(shi)、職(zhi)(zhi)(zhi)工(gong)(gong)(gong)監事(shi)履職(zhi)(zhi)(zhi)規(gui)則。在董(dong)事(shi)會、監事(shi)會研究決(jue)定(ding)公司重大問題時,職(zhi)(zhi)(zhi)工(gong)(gong)(gong)董(dong)事(shi)、職(zhi)(zhi)(zhi)工(gong)(gong)(gong)監事(shi)應(ying)充分發表意見,反映(ying)職(zhi)(zhi)(zhi)工(gong)(gong)(gong)合(he)理訴求(qiu),維護職(zhi)(zhi)(zhi)工(gong)(gong)(gong)和公司合(he)法(fa)權(quan)益。

六、健全勞動(dong)關系矛盾調處(chu)機制

(十六)完善(shan)勞動(dong)(dong)關(guan)(guan)系群(qun)體(ti)性(xing)(xing)(xing)事件(jian)預防和(he)(he)應急(ji)(ji)處置(zhi)機制。加強對(dui)勞動(dong)(dong)關(guan)(guan)系形勢(shi)的(de)分析研判,建立勞動(dong)(dong)關(guan)(guan)系群(qun)體(ti)性(xing)(xing)(xing)糾紛(fen)的(de)經常性(xing)(xing)(xing)排查和(he)(he)動(dong)(dong)態監測預警(jing)制度,及時發(fa)現和(he)(he)積極解(jie)決勞動(dong)(dong)關(guan)(guan)系領域的(de)苗頭(tou)性(xing)(xing)(xing)、傾向(xiang)性(xing)(xing)(xing)問題,有效防范群(qun)體(ti)性(xing)(xing)(xing)事件(jian)。完善(shan)應急(ji)(ji)預案,明(ming)確分級響應、處置(zhi)程(cheng)序和(he)(he)處置(zhi)措施。健全黨委領導下的(de)政(zheng)府負責,有關(guan)(guan)部(bu)門(men)和(he)(he)工會、企(qi)業(ye)代表(biao)組織共(gong)同參與的(de)群(qun)體(ti)性(xing)(xing)(xing)事件(jian)應急(ji)(ji)聯(lian)動(dong)(dong)處置(zhi)機制,形成快速反應和(he)(he)處置(zhi)工作合力,督促(cu)指導企(qi)業(ye)落實主(zhu)體(ti)責任,及時妥善(shan)處置(zhi)群(qun)體(ti)性(xing)(xing)(xing)事件(jian)。

七、營造構建和諧勞動(dong)關系(xi)的(de)良好環境
