中共中央 國務院關于構建和諧勞動關系的意見 (2015年3月21日)

為全(quan)面貫徹黨(dang)的(de)十(shi)八大(da)和(he)十(shi)八屆二中(zhong)(zhong)、三中(zhong)(zhong)、四中(zhong)(zhong)全(quan)會精神,構(gou)建和(he)諧(xie)勞動(dong)關系,推動(dong)科學發展,促進社會和(he)諧(xie),現提出如下意見。

一、充分認識構(gou)建(jian)和諧勞動關系的重大意義

勞(lao)(lao)(lao)(lao)動關(guan)(guan)系(xi)是(shi)(shi)生(sheng)產關(guan)(guan)系(xi)的(de)(de)(de)重(zhong)要組成(cheng)部分(fen),是(shi)(shi)最(zui)基本、最(zui)重(zhong)要的(de)(de)(de)社(she)(she)會關(guan)(guan)系(xi)之一(yi)。勞(lao)(lao)(lao)(lao)動關(guan)(guan)系(xi)是(shi)(shi)否和(he)(he)諧(xie),事關(guan)(guan)廣大職工(gong)(gong)和(he)(he)企業的(de)(de)(de)切身利益,事關(guan)(guan)經濟發展與社(she)(she)會和(he)(he)諧(xie)。黨(dang)和(he)(he)國家歷來高度重(zhong)視構(gou)建(jian)(jian)和(he)(he)諧(xie)勞(lao)(lao)(lao)(lao)動關(guan)(guan)系(xi),制定(ding)了(le)一(yi)系(xi)列法律法規和(he)(he)政策措施(shi)并作出(chu)工(gong)(gong)作部署(shu)。各級黨(dang)委和(he)(he)政府認真(zhen)貫徹落實黨(dang)中央和(he)(he)國務(wu)院的(de)(de)(de)決(jue)策部署(shu),取得了(le)積極成(cheng)效,總體保持了(le)全國勞(lao)(lao)(lao)(lao)動關(guan)(guan)系(xi)和(he)(he)諧(xie)穩定(ding)。但是(shi)(shi),我國正處于經濟社(she)(she)會轉型(xing)時期(qi)(qi),勞(lao)(lao)(lao)(lao)動關(guan)(guan)系(xi)的(de)(de)(de)主體及其利益訴求越(yue)來越(yue)多(duo)元化(hua),勞(lao)(lao)(lao)(lao)動關(guan)(guan)系(xi)矛盾已進入凸顯期(qi)(qi)和(he)(he)多(duo)發期(qi)(qi),勞(lao)(lao)(lao)(lao)動爭議案件(jian)居高不下(xia),有(you)的(de)(de)(de)地方拖(tuo)欠農民工(gong)(gong)工(gong)(gong)資等(deng)損害(hai)職工(gong)(gong)利益的(de)(de)(de)現象仍較突出(chu),集體停工(gong)(gong)和(he)(he)群體性(xing)事件(jian)時有(you)發生(sheng),構(gou)建(jian)(jian)和(he)(he)諧(xie)勞(lao)(lao)(lao)(lao)動關(guan)(guan)系(xi)的(de)(de)(de)任務(wu)艱(jian)巨(ju)繁重(zhong)。

黨(dang)的(de)(de)十八大(da)明確(que)提出(chu)構建和(he)諧勞動(dong)(dong)(dong)關(guan)系(xi)。在新(xin)的(de)(de)歷史條件下(xia),努力(li)構建中國特色和(he)諧勞動(dong)(dong)(dong)關(guan)系(xi),是加(jia)強和(he)創新(xin)社(she)(she)會管(guan)理、保障和(he)改善民生的(de)(de)重要內容,是建設社(she)(she)會主義和(he)諧社(she)(she)會的(de)(de)重要基礎,是經濟(ji)持續(xu)健康發展(zhan)的(de)(de)重要保證,是增強黨(dang)的(de)(de)執政基礎、鞏(gong)固(gu)黨(dang)的(de)(de)執政地位(wei)的(de)(de)必然(ran)要求(qiu)。各級黨(dang)委和(he)政府(fu)要從奪取中國特色社(she)(she)會主義新(xin)勝利的(de)(de)全局和(he)戰略高度(du),深刻認(ren)識構建和(he)諧勞動(dong)(dong)(dong)關(guan)系(xi)的(de)(de)重大(da)意義,切實增強責任感和(he)使命感,把構建和(he)諧勞動(dong)(dong)(dong)關(guan)系(xi)作為一(yi)項緊(jin)迫任務,擺在更加(jia)突出(chu)的(de)(de)位(wei)置,采取有力(li)措施(shi)抓實抓好。

二、構建和諧勞動(dong)關系的指導(dao)思想、工作原則和目標任務

(一)指導(dao)思想。全面貫(guan)徹黨(dang)的(de)十(shi)八(ba)大和(he)十(shi)八(ba)屆二中(zhong)、三(san)中(zhong)、四中(zhong)全會(hui)精神,以鄧小平理(li)論、“三(san)個(ge)代表”重(zhong)要思想、科學(xue)發(fa)(fa)展(zhan)觀為指導(dao),深(shen)入貫(guan)徹習近平總書記(ji)系(xi)列(lie)重(zhong)要講(jiang)話精神,貫(guan)徹落(luo)實(shi)黨(dang)中(zhong)央(yang)和(he)國務院的(de)決策部(bu)署,堅(jian)持(chi)促(cu)進企業發(fa)(fa)展(zhan)、維(wei)護(hu)職(zhi)工權益,堅(jian)持(chi)正確處理(li)改革發(fa)(fa)展(zhan)穩定關(guan)系(xi),推動(dong)中(zhong)國特(te)色和(he)諧(xie)勞動(dong)關(guan)系(xi)的(de)建設和(he)發(fa)(fa)展(zhan),最大限(xian)度(du)(du)增加勞動(dong)關(guan)系(xi)和(he)諧(xie)因素(su),最大限(xian)度(du)(du)減少不和(he)諧(xie)因素(su),促(cu)進經濟持(chi)續(xu)健康發(fa)(fa)展(zhan)和(he)社會(hui)和(he)諧(xie)穩定,凝聚(ju)廣大職(zhi)工為實(shi)現“兩個(ge)一百年”奮斗目標、實(shi)現中(zhong)華民族偉大復(fu)興的(de)中(zhong)國夢(meng)貢獻力量。

(二)工作原則

——堅持以人(ren)為本(ben)。把解決廣大職工(gong)最關心、最直接、最現(xian)實(shi)的利益問(wen)題,切實(shi)維(wei)護其根本(ben)權益,作為構建和諧(xie)勞動關系的根本(ben)出發點和落(luo)腳點。

——堅持(chi)依法(fa)(fa)(fa)構(gou)建。健(jian)全(quan)勞(lao)動保(bao)障法(fa)(fa)(fa)律法(fa)(fa)(fa)規,增強企業(ye)依法(fa)(fa)(fa)用工(gong)意識,提高職工(gong)依法(fa)(fa)(fa)維權能力,加(jia)強勞(lao)動保(bao)障執(zhi)法(fa)(fa)(fa)監督(du)和勞(lao)動糾紛調(diao)處,依法(fa)(fa)(fa)處理勞(lao)動關系(xi)矛盾,把勞(lao)動關系(xi)的建立、運行、監督(du)、調(diao)處的全(quan)過程納(na)入法(fa)(fa)(fa)治化(hua)軌道。

——堅持共建(jian)共享。統籌處(chu)理好(hao)促進企業發展和(he)維護(hu)職工(gong)(gong)權益的關(guan)系(xi),調動(dong)勞(lao)動(dong)關(guan)系(xi)主體雙方的積(ji)極性、主動(dong)性,推動(dong)企業和(he)職工(gong)(gong)協商共事(shi)、機制共建(jian)、效益共創、利益共享。

——堅持改革(ge)創(chuang)新(xin)。從(cong)我國(guo)基本經(jing)濟(ji)(ji)制度(du)(du)出發,統(tong)籌考慮公有(you)制經(jing)濟(ji)(ji)、非公有(you)制經(jing)濟(ji)(ji)和(he)混合(he)所有(you)制經(jing)濟(ji)(ji)的特點(dian),不(bu)斷探究和(he)把握(wo)社會主義(yi)市場經(jing)濟(ji)(ji)條件下勞動關(guan)系的規律性,積極(ji)穩妥推進(jin)具(ju)有(you)中國(guo)特色的勞動關(guan)系工作理論、體制、制度(du)(du)、機制和(he)方(fang)法創(chuang)新(xin)。

(三)目標(biao)任(ren)務。加(jia)(jia)強調整勞(lao)動關系的(de)(de)法律、體(ti)制、制度、機制和(he)能(neng)力建設,加(jia)(jia)快(kuai)健全(quan)黨委領(ling)導、政府負責、社會協同、企業(ye)和(he)職(zhi)工(gong)(gong)參(can)與、法治(zhi)保(bao)障(zhang)的(de)(de)工(gong)(gong)作體(ti)制,加(jia)(jia)快(kuai)形成源頭治(zhi)理(li)(li)、動態管(guan)理(li)(li)、應(ying)急(ji)處(chu)置相(xiang)結合(he)的(de)(de)工(gong)(gong)作機制,實現勞(lao)動用工(gong)(gong)更加(jia)(jia)規范(fan),職(zhi)工(gong)(gong)工(gong)(gong)資合(he)理(li)(li)增長,勞(lao)動條(tiao)件不斷(duan)改善,職(zhi)工(gong)(gong)安(an)全(quan)健康得到切實保(bao)障(zhang),社會保(bao)險全(quan)面覆蓋,人文關懷(huai)日(ri)益加(jia)(jia)強,有效預防和(he)化解勞(lao)動關系矛盾,建立規范(fan)有序、公(gong)正合(he)理(li)(li)、互利共(gong)贏、和(he)諧(xie)穩定的(de)(de)勞(lao)動關系。

三、依法保障職工基本權(quan)益

(四)切(qie)實保(bao)(bao)障職工(gong)(gong)(gong)取得勞動報(bao)(bao)酬(chou)(chou)的權利。完善并落(luo)實工(gong)(gong)(gong)資(zi)支(zhi)付規定,健全工(gong)(gong)(gong)資(zi)支(zhi)付監控、工(gong)(gong)(gong)資(zi)保(bao)(bao)證金(jin)和欠薪(xin)應(ying)急周轉金(jin)制(zhi)度(du),探(tan)索建立欠薪(xin)保(bao)(bao)障金(jin)制(zhi)度(du),落(luo)實清償(chang)欠薪(xin)的施(shi)工(gong)(gong)(gong)總承包企業負責制(zhi),依法懲處拒不支(zhi)付勞動報(bao)(bao)酬(chou)(chou)等違法犯罪行為,保(bao)(bao)障職工(gong)(gong)(gong)特別(bie)是農民工(gong)(gong)(gong)按時足額(e)領到工(gong)(gong)(gong)資(zi)報(bao)(bao)酬(chou)(chou)。努(nu)力實現農民工(gong)(gong)(gong)與城鎮就業人員同工(gong)(gong)(gong)同酬(chou)(chou)。

(五)切實(shi)保障職(zhi)工(gong)(gong)休(xiu)(xiu)息休(xiu)(xiu)假(jia)(jia)的(de)權(quan)利(li)。完善并落實(shi)國家關于職(zhi)工(gong)(gong)工(gong)(gong)作(zuo)時(shi)間、全國年(nian)節及紀念日假(jia)(jia)期、帶薪年(nian)休(xiu)(xiu)假(jia)(jia)等(deng)規定(ding)(ding),規范(fan)企(qi)業(ye)實(shi)行(xing)特殊工(gong)(gong)時(shi)制度的(de)審(shen)批管理,督促企(qi)業(ye)依法安排(pai)職(zhi)工(gong)(gong)休(xiu)(xiu)息休(xiu)(xiu)假(jia)(jia)。企(qi)業(ye)因生產經營需要安排(pai)職(zhi)工(gong)(gong)延長工(gong)(gong)作(zuo)時(shi)間的(de),應與工(gong)(gong)會和職(zhi)工(gong)(gong)協商,并依法足額(e)支付(fu)加(jia)(jia)(jia)班加(jia)(jia)(jia)點工(gong)(gong)資。加(jia)(jia)(jia)強勞動定(ding)(ding)額(e)定(ding)(ding)員標(biao)(biao)準化(hua)工(gong)(gong)作(zuo),推動勞動定(ding)(ding)額(e)定(ding)(ding)員國家標(biao)(biao)準、行(xing)業(ye)標(biao)(biao)準的(de)制定(ding)(ding)修訂(ding),指導(dao)企(qi)業(ye)制定(ding)(ding)實(shi)施(shi)科學合理的(de)勞動定(ding)(ding)額(e)定(ding)(ding)員標(biao)(biao)準,保障職(zhi)工(gong)(gong)的(de)休(xiu)(xiu)息權(quan)利(li)。

(六)切實保(bao)(bao)(bao)障職工(gong)獲得勞(lao)動安(an)(an)(an)全(quan)(quan)衛生(sheng)(sheng)保(bao)(bao)(bao)護(hu)(hu)的(de)權利。加(jia)強勞(lao)動安(an)(an)(an)全(quan)(quan)衛生(sheng)(sheng)執(zhi)(zhi)法監督(du)(du),督(du)(du)促(cu)企業(ye)(ye)健(jian)全(quan)(quan)并(bing)落實勞(lao)動安(an)(an)(an)全(quan)(quan)衛生(sheng)(sheng)責任制,嚴格執(zhi)(zhi)行(xing)(xing)國家(jia)(jia)勞(lao)動安(an)(an)(an)全(quan)(quan)衛生(sheng)(sheng)保(bao)(bao)(bao)護(hu)(hu)標準,加(jia)大安(an)(an)(an)全(quan)(quan)生(sheng)(sheng)產投(tou)入,強化安(an)(an)(an)全(quan)(quan)生(sheng)(sheng)產和職業(ye)(ye)衛生(sheng)(sheng)教育(yu)培訓,提供(gong)符合國家(jia)(jia)規定的(de)勞(lao)動安(an)(an)(an)全(quan)(quan)衛生(sheng)(sheng)條件(jian)和勞(lao)動保(bao)(bao)(bao)護(hu)(hu)用品(pin),對從(cong)事有職業(ye)(ye)危害作業(ye)(ye)的(de)職工(gong)按照國家(jia)(jia)規定進行(xing)(xing)上(shang)崗(gang)前、在(zai)崗(gang)期間和離崗(gang)時的(de)職業(ye)(ye)健(jian)康檢查(cha),加(jia)強女職工(gong)和未成年(nian)工(gong)特殊勞(lao)動保(bao)(bao)(bao)護(hu)(hu),最(zui)大限(xian)度地減(jian)少生(sheng)(sheng)產安(an)(an)(an)全(quan)(quan)事故和職業(ye)(ye)病(bing)危害。

(七)切(qie)實保(bao)(bao)(bao)障職(zhi)(zhi)(zhi)(zhi)工(gong)(gong)享受社(she)(she)會保(bao)(bao)(bao)險(xian)和(he)(he)接受職(zhi)(zhi)(zhi)(zhi)業(ye)(ye)技(ji)能(neng)培(pei)訓(xun)的權利。認真貫徹實施社(she)(she)會保(bao)(bao)(bao)險(xian)法(fa),繼續(xu)(xu)完善社(she)(she)會保(bao)(bao)(bao)險(xian)關(guan)系(xi)轉移接續(xu)(xu)辦法(fa),努(nu)力實現(xian)社(she)(she)會保(bao)(bao)(bao)險(xian)全面覆(fu)蓋,落實廣大職(zhi)(zhi)(zhi)(zhi)工(gong)(gong)特別是(shi)農民(min)工(gong)(gong)和(he)(he)勞(lao)務派遣工(gong)(gong)的社(she)(she)會保(bao)(bao)(bao)險(xian)權益。督(du)促企業(ye)(ye)依法(fa)為職(zhi)(zhi)(zhi)(zhi)工(gong)(gong)繳納(na)各項社(she)(she)會保(bao)(bao)(bao)險(xian)費,鼓(gu)勵(li)有條件的企業(ye)(ye)按照法(fa)律(lv)法(fa)規和(he)(he)有關(guan)規定為職(zhi)(zhi)(zhi)(zhi)工(gong)(gong)建立補充保(bao)(bao)(bao)險(xian)。引導職(zhi)(zhi)(zhi)(zhi)工(gong)(gong)自覺履(lv)行法(fa)定義(yi)務,積極參(can)加社(she)(she)會保(bao)(bao)(bao)險(xian)。加強對(dui)職(zhi)(zhi)(zhi)(zhi)工(gong)(gong)的職(zhi)(zhi)(zhi)(zhi)業(ye)(ye)技(ji)能(neng)培(pei)訓(xun),鼓(gu)勵(li)職(zhi)(zhi)(zhi)(zhi)工(gong)(gong)參(can)加學歷(li)教育和(he)(he)繼續(xu)(xu)教育,提高職(zhi)(zhi)(zhi)(zhi)工(gong)(gong)文化知(zhi)識水平(ping)和(he)(he)技(ji)能(neng)水平(ping)。

四、健全(quan)勞動關系協調機制

(八(ba))全(quan)面實行勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)制度。貫徹落實好(hao)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)法等(deng)法律(lv)法規(gui),加(jia)強對企業(ye)(ye)(ye)實行勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)制度的(de)(de)(de)監督、指導(dao)和服務(wu)(wu),在用工(gong)季節性強、職工(gong)流動(dong)(dong)(dong)(dong)(dong)(dong)性大的(de)(de)(de)行業(ye)(ye)(ye)推(tui)廣(guang)簡易勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)示(shi)范文本,依(yi)(yi)法規(gui)范勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)訂立、履(lv)行、變更(geng)、解除、終止等(deng)行為,切(qie)實提高勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)簽訂率(lv)和履(lv)行質量。依(yi)(yi)法加(jia)強對勞(lao)(lao)(lao)(lao)(lao)務(wu)(wu)派遣(qian)的(de)(de)(de)監管(guan),規(gui)范非(fei)全(quan)日(ri)制、勞(lao)(lao)(lao)(lao)(lao)務(wu)(wu)承攬(lan)、勞(lao)(lao)(lao)(lao)(lao)務(wu)(wu)外包用工(gong)和企業(ye)(ye)(ye)裁員行為。指導(dao)企業(ye)(ye)(ye)建立健全(quan)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)規(gui)章制度,提升勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)用工(gong)管(guan)理(li)水平。全(quan)面推(tui)進勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)用工(gong)信息申報備(bei)案制度建設,加(jia)強對企業(ye)(ye)(ye)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)用工(gong)的(de)(de)(de)動(dong)(dong)(dong)(dong)(dong)(dong)態管(guan)理(li)。

(九)推行(xing)集體(ti)(ti)協商(shang)和(he)集體(ti)(ti)合同制(zhi)(zhi)(zhi)度。以非(fei)公有制(zhi)(zhi)(zhi)企業(ye)(ye)(ye)(ye)為(wei)重(zhong)點對象,依法推進工(gong)(gong)(gong)資集體(ti)(ti)協商(shang),不斷擴大覆蓋面、增(zeng)強(qiang)(qiang)實效性,形成反映人力資源市場供求(qiu)關(guan)系和(he)企業(ye)(ye)(ye)(ye)經濟(ji)效益的工(gong)(gong)(gong)資決(jue)定(ding)機制(zhi)(zhi)(zhi)和(he)正常增(zeng)長機制(zhi)(zhi)(zhi)。完善工(gong)(gong)(gong)資指導線制(zhi)(zhi)(zhi)度,加(jia)快建立統一(yi)規范的企業(ye)(ye)(ye)(ye)薪酬調查和(he)信(xin)息發布制(zhi)(zhi)(zhi)度,為(wei)開展工(gong)(gong)(gong)資集體(ti)(ti)協商(shang)提供參考。推動企業(ye)(ye)(ye)(ye)與職工(gong)(gong)(gong)就工(gong)(gong)(gong)作條(tiao)件、勞動定(ding)額、女職工(gong)(gong)(gong)特殊保護等(deng)開展集體(ti)(ti)協商(shang),訂立集體(ti)(ti)合同。加(jia)強(qiang)(qiang)集體(ti)(ti)協商(shang)代(dai)表能力建設,提高(gao)協商(shang)水平。加(jia)強(qiang)(qiang)對集體(ti)(ti)協商(shang)過程的指導,督促企業(ye)(ye)(ye)(ye)和(he)職工(gong)(gong)(gong)認真(zhen)履行(xing)集體(ti)(ti)合同。

(十)健全協(xie)調勞(lao)動(dong)關(guan)(guan)(guan)系(xi)三(san)方機(ji)(ji)制。完善(shan)協(xie)調勞(lao)動(dong)關(guan)(guan)(guan)系(xi)三(san)方機(ji)(ji)制組織體系(xi),建(jian)立健全由人(ren)力資源社(she)會(hui)(hui)(hui)保障部(bu)門會(hui)(hui)(hui)同工(gong)(gong)會(hui)(hui)(hui)和(he)企(qi)業聯合(he)會(hui)(hui)(hui)、工(gong)(gong)商(shang)業聯合(he)會(hui)(hui)(hui)等企(qi)業代(dai)(dai)表(biao)組織組成的(de)三(san)方機(ji)(ji)制,根據(ju)實際需要(yao)推動(dong)工(gong)(gong)業園(yuan)區、鄉(xiang)鎮(街道)和(he)產業系(xi)統建(jian)立三(san)方機(ji)(ji)制。加強(qiang)和(he)創(chuang)新三(san)方機(ji)(ji)制組織建(jian)設(she),建(jian)立健全協(xie)調勞(lao)動(dong)關(guan)(guan)(guan)系(xi)三(san)方委員會(hui)(hui)(hui),由同級政(zheng)府領(ling)導擔(dan)任委員會(hui)(hui)(hui)主任。完善(shan)三(san)方機(ji)(ji)制職(zhi)能,健全工(gong)(gong)作制度,充(chong)分發揮政(zheng)府、工(gong)(gong)會(hui)(hui)(hui)和(he)企(qi)業代(dai)(dai)表(biao)組織共(gong)同研究解決有關(guan)(guan)(guan)勞(lao)動(dong)關(guan)(guan)(guan)系(xi)重(zhong)大問題的(de)重(zhong)要(yao)作用(yong)。

五、加(jia)強企業民(min)主(zhu)管理制(zhi)度建設(she)

(十二)推(tui)進(jin)廠務(wu)(wu)公(gong)(gong)開(kai)(kai)(kai)制(zhi)度(du)化、規范化。進(jin)一步提(ti)高(gao)廠務(wu)(wu)公(gong)(gong)開(kai)(kai)(kai)建制(zhi)率,加強國有(you)企業改制(zhi)重組過程中的廠務(wu)(wu)公(gong)(gong)開(kai)(kai)(kai),積極穩妥推(tui)進(jin)非公(gong)(gong)有(you)制(zhi)企業廠務(wu)(wu)公(gong)(gong)開(kai)(kai)(kai)制(zhi)度(du)建設。完善公(gong)(gong)開(kai)(kai)(kai)程序,充實公(gong)(gong)開(kai)(kai)(kai)內(nei)容,創新(xin)公(gong)(gong)開(kai)(kai)(kai)形式(shi),探(tan)索和推(tui)行經理接待日、勞資懇談會、總經理信箱等多種形式(shi)的公(gong)(gong)開(kai)(kai)(kai)。

(十三)推(tui)行(xing)職(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)董事(shi)(shi)(shi)(shi)(shi)(shi)、職(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)監(jian)(jian)事(shi)(shi)(shi)(shi)(shi)(shi)制(zhi)度(du)。按照公(gong)司法(fa)規定,在(zai)(zai)公(gong)司制(zhi)企(qi)業(ye)建立職(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)董事(shi)(shi)(shi)(shi)(shi)(shi)、職(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)監(jian)(jian)事(shi)(shi)(shi)(shi)(shi)(shi)制(zhi)度(du)。依法(fa)規范職(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)董事(shi)(shi)(shi)(shi)(shi)(shi)、職(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)監(jian)(jian)事(shi)(shi)(shi)(shi)(shi)(shi)履(lv)職(zhi)(zhi)(zhi)(zhi)規則。在(zai)(zai)董事(shi)(shi)(shi)(shi)(shi)(shi)會、監(jian)(jian)事(shi)(shi)(shi)(shi)(shi)(shi)會研究決定公(gong)司重(zhong)大問(wen)題時,職(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)董事(shi)(shi)(shi)(shi)(shi)(shi)、職(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)監(jian)(jian)事(shi)(shi)(shi)(shi)(shi)(shi)應充分發表意見,反映職(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)合理訴求(qiu),維護職(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)和公(gong)司合法(fa)權(quan)益。

六、健全勞動關系矛(mao)盾調處機制

(十(shi)四(si))健全(quan)(quan)(quan)勞(lao)動(dong)(dong)保障(zhang)監(jian)察(cha)(cha)制(zhi)度(du)。全(quan)(quan)(quan)面推進(jin)勞(lao)動(dong)(dong)保障(zhang)監(jian)察(cha)(cha)網格化、網絡化管理,實現監(jian)察(cha)(cha)執(zhi)法(fa)(fa)向主動(dong)(dong)預(yu)防(fang)和(he)統籌城(cheng)鄉轉變。創新監(jian)察(cha)(cha)執(zhi)法(fa)(fa)方式(shi),規范執(zhi)法(fa)(fa)行為,進(jin)一步暢通舉報(bao)投(tou)訴渠道,擴大(da)日(ri)常巡(xun)視檢查(cha)和(he)書面審查(cha)覆蓋范圍,強化對突出問題的專項整治。建立(li)健全(quan)(quan)(quan)違(wei)法(fa)(fa)行為預(yu)警防(fang)控機制(zhi),完(wan)善多部門(men)綜(zong)合治理和(he)監(jian)察(cha)(cha)執(zhi)法(fa)(fa)與刑事司法(fa)(fa)聯動(dong)(dong)機制(zhi),加大(da)對非(fei)法(fa)(fa)用工尤其是大(da)案(an)(an)要案(an)(an)的查(cha)處力度(du),嚴(yan)厲打擊使用童工、強迫勞(lao)動(dong)(dong)、拒不支付勞(lao)動(dong)(dong)報(bao)酬等違(wei)法(fa)(fa)犯(fan)罪行為。加強勞(lao)動(dong)(dong)保障(zhang)誠(cheng)(cheng)信評(ping)價制(zhi)度(du)建設(she),建立(li)健全(quan)(quan)(quan)企業誠(cheng)(cheng)信檔案(an)(an)。

(十五)健(jian)全勞(lao)動(dong)(dong)(dong)爭議(yi)(yi)調(diao)(diao)(diao)解仲(zhong)裁(cai)(cai)機(ji)制(zhi)(zhi)。堅(jian)持(chi)預防為(wei)主(zhu)、基層為(wei)主(zhu)、調(diao)(diao)(diao)解為(wei)主(zhu)的工(gong)作方(fang)針(zhen),加強(qiang)(qiang)企業(ye)勞(lao)動(dong)(dong)(dong)爭議(yi)(yi)調(diao)(diao)(diao)解委員會建(jian)(jian)設,推(tui)動(dong)(dong)(dong)各類企業(ye)普遍建(jian)(jian)立(li)內部勞(lao)動(dong)(dong)(dong)爭議(yi)(yi)協(xie)(xie)(xie)(xie)商調(diao)(diao)(diao)解機(ji)制(zhi)(zhi)。大(da)力推(tui)動(dong)(dong)(dong)鄉(xiang)鎮(街道)、村(cun)(社(she)區)依法建(jian)(jian)立(li)勞(lao)動(dong)(dong)(dong)爭議(yi)(yi)調(diao)(diao)(diao)解組織(zhi),支持(chi)工(gong)會、商(協(xie)(xie)(xie)(xie))會依法建(jian)(jian)立(li)行業(ye)性、區域性勞(lao)動(dong)(dong)(dong)爭議(yi)(yi)調(diao)(diao)(diao)解組織(zhi)。完(wan)(wan)善勞(lao)動(dong)(dong)(dong)爭議(yi)(yi)調(diao)(diao)(diao)解制(zhi)(zhi)度,大(da)力加強(qiang)(qiang)專業(ye)性勞(lao)動(dong)(dong)(dong)爭議(yi)(yi)調(diao)(diao)(diao)解工(gong)作,健(jian)全人民調(diao)(diao)(diao)解、行政(zheng)調(diao)(diao)(diao)解、仲(zhong)裁(cai)(cai)調(diao)(diao)(diao)解、司法調(diao)(diao)(diao)解聯(lian)動(dong)(dong)(dong)工(gong)作體(ti)(ti)系,充分(fen)發(fa)(fa)揮(hui)協(xie)(xie)(xie)(xie)商、調(diao)(diao)(diao)解在(zai)處理勞(lao)動(dong)(dong)(dong)爭議(yi)(yi)中的基礎性作用。完(wan)(wan)善勞(lao)動(dong)(dong)(dong)人事爭議(yi)(yi)仲(zhong)裁(cai)(cai)辦案(an)制(zhi)(zhi)度,規范(fan)辦案(an)程(cheng)序,加大(da)仲(zhong)裁(cai)(cai)辦案(an)督查力度,進一步提(ti)高仲(zhong)裁(cai)(cai)效能和辦案(an)質量,促進案(an)件(jian)仲(zhong)裁(cai)(cai)終結。加強(qiang)(qiang)裁(cai)(cai)審銜接(jie)與工(gong)作協(xie)(xie)(xie)(xie)調(diao)(diao)(diao),積極探索(suo)建(jian)(jian)立(li)訴訟與仲(zhong)裁(cai)(cai)程(cheng)序有效銜接(jie)、裁(cai)(cai)審標準(zhun)統一的新規則、新制(zhi)(zhi)度。暢通法律援助渠道,依法及時為(wei)符合條件(jian)的職工(gong)提(ti)供法律援助,切實維護當事人合法權益(yi)。依托協(xie)(xie)(xie)(xie)調(diao)(diao)(diao)勞(lao)動(dong)(dong)(dong)關(guan)系三方(fang)機(ji)制(zhi)(zhi)完(wan)(wan)善協(xie)(xie)(xie)(xie)調(diao)(diao)(diao)處理集(ji)體(ti)(ti)協(xie)(xie)(xie)(xie)商爭議(yi)(yi)的辦法,有效調(diao)(diao)(diao)處因簽訂集(ji)體(ti)(ti)合同發(fa)(fa)生的爭議(yi)(yi)和集(ji)體(ti)(ti)停(ting)工(gong)事件(jian)。

(十六)完善(shan)(shan)勞動(dong)關(guan)(guan)系(xi)群(qun)體(ti)(ti)性(xing)(xing)(xing)事(shi)件(jian)(jian)預(yu)防和(he)(he)應(ying)急處置(zhi)(zhi)(zhi)機(ji)制。加強對勞動(dong)關(guan)(guan)系(xi)形(xing)勢的(de)(de)分析研判,建(jian)立勞動(dong)關(guan)(guan)系(xi)群(qun)體(ti)(ti)性(xing)(xing)(xing)糾(jiu)紛的(de)(de)經(jing)常性(xing)(xing)(xing)排查和(he)(he)動(dong)態(tai)監測(ce)預(yu)警(jing)制度,及時(shi)發現(xian)和(he)(he)積極解決勞動(dong)關(guan)(guan)系(xi)領域(yu)的(de)(de)苗頭(tou)性(xing)(xing)(xing)、傾向性(xing)(xing)(xing)問題,有效防范群(qun)體(ti)(ti)性(xing)(xing)(xing)事(shi)件(jian)(jian)。完善(shan)(shan)應(ying)急預(yu)案(an),明確分級響應(ying)、處置(zhi)(zhi)(zhi)程序(xu)和(he)(he)處置(zhi)(zhi)(zhi)措(cuo)施。健全黨委領導(dao)下的(de)(de)政(zheng)府負責,有關(guan)(guan)部門和(he)(he)工會、企業代(dai)表組織共同參與的(de)(de)群(qun)體(ti)(ti)性(xing)(xing)(xing)事(shi)件(jian)(jian)應(ying)急聯動(dong)處置(zhi)(zhi)(zhi)機(ji)制,形(xing)成快(kuai)速反應(ying)和(he)(he)處置(zhi)(zhi)(zhi)工作(zuo)合力,督(du)促指(zhi)導(dao)企業落實主體(ti)(ti)責任,及時(shi)妥善(shan)(shan)處置(zhi)(zhi)(zhi)群(qun)體(ti)(ti)性(xing)(xing)(xing)事(shi)件(jian)(jian)。

七、營(ying)造(zao)構建(jian)和諧勞(lao)動關系(xi)的良好環境

(十(shi)七)加強對(dui)職工的教育引導(dao)(dao)。在廣大職工中加強思想政(zheng)治(zhi)教育,引導(dao)(dao)職工樹立正確(que)(que)的世界(jie)觀(guan)、人生觀(guan)、價值觀(guan),追(zhui)求高尚(shang)的職業理(li)(li)想,培養良好(hao)的職業道德(de),增強對(dui)企業的責任感、認同(tong)感和歸屬感,愛崗敬(jing)業、遵守紀律、誠實守信,自覺履行勞動義務。加強有關(guan)法(fa)律法(fa)規政(zheng)策宣(xuan)傳工作,在努力(li)解(jie)決職工切身利(li)益問題的同(tong)時(shi),引導(dao)(dao)職工正確(que)(que)對(dui)待社(she)會(hui)利(li)益關(guan)系調整(zheng),合理(li)(li)確(que)(que)定提高工資收入等(deng)訴(su)求預期,以理(li)(li)性(xing)合法(fa)形式表達利(li)益訴(su)求、解(jie)決利(li)益矛(mao)盾、維(wei)護自身權益。

(十八)加(jia)強(qiang)對(dui)(dui)職工(gong)(gong)的人文(wen)(wen)關(guan)懷。培育富有特色的企業精神(shen)(shen)和健康向上的香(xiang)蕉(jiao)视频下(xia)载,為職工(gong)(gong)構建(jian)(jian)共同的精神(shen)(shen)家園。注重職工(gong)(gong)的精神(shen)(shen)需(xu)求和心理健康,及(ji)時(shi)了解(jie)掌握(wo)職工(gong)(gong)思想動(dong)態,有針對(dui)(dui)性地做好思想引(yin)導(dao)和心理疏(shu)導(dao)工(gong)(gong)作,建(jian)(jian)立心理危機(ji)干(gan)預(yu)預(yu)警機(ji)制。加(jia)強(qiang)企業文(wen)(wen)體娛(yu)樂設施(shi)建(jian)(jian)設,積極(ji)組織職工(gong)(gong)開(kai)展喜(xi)聞樂見、豐富多(duo)彩的文(wen)(wen)化(hua)體育活(huo)動(dong),豐富職工(gong)(gong)文(wen)(wen)化(hua)生活(huo)。拓(tuo)寬職工(gong)(gong)的發展渠道,拓(tuo)展職業發展空間。

(二十)優化企(qi)(qi)業(ye)發展(zhan)環境。加(jia)強和(he)改進(jin)(jin)政(zheng)府的管(guan)理(li)服務(wu),減(jian)(jian)少和(he)規范涉企(qi)(qi)行政(zheng)審(shen)批(pi)事項(xiang),提高審(shen)批(pi)事項(xiang)的工作(zuo)效率,激(ji)發市場主體創造(zao)活力。加(jia)大(da)對中小企(qi)(qi)業(ye)政(zheng)策扶(fu)(fu)持力度,特(te)別是(shi)推進(jin)(jin)扶(fu)(fu)持小微企(qi)(qi)業(ye)發展(zhan)的各項(xiang)政(zheng)策落實落地,進(jin)(jin)一步減(jian)(jian)輕企(qi)(qi)業(ye)負擔。加(jia)強技術支持,引導企(qi)(qi)業(ye)主動轉型升級,緊緊依靠科技進(jin)(jin)步、職工素質(zhi)提升和(he)管(guan)理(li)創新,不斷提升競爭力。通(tong)過促進(jin)(jin)企(qi)(qi)業(ye)發展(zhan),為構建和(he)諧勞動關系創造(zao)物質(zhi)條件。

(二十一(yi))加強(qiang)構(gou)建和(he)諧勞(lao)動(dong)關系(xi)的(de)法(fa)(fa)(fa)治(zhi)保(bao)(bao)障(zhang)(zhang)。進(jin)一(yi)步(bu)(bu)完善(shan)勞(lao)動(dong)法(fa)(fa)(fa)、勞(lao)動(dong)合同法(fa)(fa)(fa)、勞(lao)動(dong)爭議調(diao)解仲裁(cai)法(fa)(fa)(fa)、社會保(bao)(bao)險法(fa)(fa)(fa)、職業病防(fang)治(zhi)法(fa)(fa)(fa)等(deng)法(fa)(fa)(fa)律(lv)的(de)配套法(fa)(fa)(fa)規(gui)、規(gui)章和(he)政策(ce),加快完善(shan)基本勞(lao)動(dong)標(biao)準、集體(ti)(ti)協商(shang)和(he)集體(ti)(ti)合同、企業工資、勞(lao)動(dong)保(bao)(bao)障(zhang)(zhang)監察、企業民主管理、協調(diao)勞(lao)動(dong)關系(xi)三方(fang)機制等(deng)方(fang)面(mian)的(de)制度,逐步(bu)(bu)健全勞(lao)動(dong)保(bao)(bao)障(zhang)(zhang)法(fa)(fa)(fa)律(lv)法(fa)(fa)(fa)規(gui)體(ti)(ti)系(xi)。深入開(kai)展法(fa)(fa)(fa)律(lv)法(fa)(fa)(fa)規(gui)宣傳教育,加強(qiang)行政執法(fa)(fa)(fa)和(he)法(fa)(fa)(fa)律(lv)監督,促進(jin)各項勞(lao)動(dong)保(bao)(bao)障(zhang)(zhang)法(fa)(fa)(fa)律(lv)法(fa)(fa)(fa)規(gui)貫徹實施。
