為全(quan)面貫(guan)徹黨的十八大和(he)十八屆二(er)中、三中、四中全(quan)會精神,構建和(he)諧(xie)勞動關系,推動科學發展,促進社(she)會和(he)諧(xie),現提出如下意見。
一、充分認識構(gou)建和諧(xie)勞動關系的重大(da)意義
勞動(dong)關(guan)(guan)系(xi)(xi)(xi)是生產關(guan)(guan)系(xi)(xi)(xi)的(de)(de)(de)重要組成(cheng)部(bu)分,是最(zui)基(ji)本、最(zui)重要的(de)(de)(de)社(she)(she)會關(guan)(guan)系(xi)(xi)(xi)之一(yi)。勞動(dong)關(guan)(guan)系(xi)(xi)(xi)是否和(he)(he)諧,事(shi)關(guan)(guan)廣(guang)大職工(gong)(gong)(gong)(gong)和(he)(he)企業的(de)(de)(de)切身利(li)(li)(li)益(yi),事(shi)關(guan)(guan)經(jing)濟(ji)發展與社(she)(she)會和(he)(he)諧。黨(dang)和(he)(he)國(guo)家(jia)歷來高度重視(shi)構(gou)建(jian)和(he)(he)諧勞動(dong)關(guan)(guan)系(xi)(xi)(xi),制定了一(yi)系(xi)(xi)(xi)列法律法規(gui)和(he)(he)政(zheng)(zheng)策措施并作出工(gong)(gong)(gong)(gong)作部(bu)署。各級黨(dang)委和(he)(he)政(zheng)(zheng)府認真貫徹(che)落實(shi)黨(dang)中央(yang)和(he)(he)國(guo)務(wu)院的(de)(de)(de)決策部(bu)署,取得了積極成(cheng)效,總體(ti)保持(chi)了全國(guo)勞動(dong)關(guan)(guan)系(xi)(xi)(xi)和(he)(he)諧穩定。但是,我國(guo)正處于經(jing)濟(ji)社(she)(she)會轉(zhuan)型時(shi)期(qi),勞動(dong)關(guan)(guan)系(xi)(xi)(xi)的(de)(de)(de)主(zhu)體(ti)及(ji)其利(li)(li)(li)益(yi)訴(su)求越(yue)來越(yue)多元化,勞動(dong)關(guan)(guan)系(xi)(xi)(xi)矛盾已(yi)進入凸顯期(qi)和(he)(he)多發期(qi),勞動(dong)爭議案件(jian)居高不下,有(you)的(de)(de)(de)地方拖(tuo)欠(qian)農民(min)工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資等(deng)損害(hai)職工(gong)(gong)(gong)(gong)利(li)(li)(li)益(yi)的(de)(de)(de)現象(xiang)仍較突出,集體(ti)停(ting)工(gong)(gong)(gong)(gong)和(he)(he)群體(ti)性事(shi)件(jian)時(shi)有(you)發生,構(gou)建(jian)和(he)(he)諧勞動(dong)關(guan)(guan)系(xi)(xi)(xi)的(de)(de)(de)任務(wu)艱巨(ju)繁重。
黨的(de)(de)十八大明確提(ti)出構建(jian)(jian)(jian)和(he)(he)(he)(he)諧勞動(dong)(dong)關(guan)系。在(zai)新的(de)(de)歷史條件下,努力(li)構建(jian)(jian)(jian)中國特色(se)和(he)(he)(he)(he)諧勞動(dong)(dong)關(guan)系,是(shi)加強和(he)(he)(he)(he)創新社會(hui)管理、保(bao)障和(he)(he)(he)(he)改善(shan)民生的(de)(de)重要內容,是(shi)建(jian)(jian)(jian)設社會(hui)主義(yi)和(he)(he)(he)(he)諧社會(hui)的(de)(de)重要基礎,是(shi)經濟持續健康(kang)發(fa)展的(de)(de)重要保(bao)證,是(shi)增(zeng)強黨的(de)(de)執政基礎、鞏固(gu)黨的(de)(de)執政地位的(de)(de)必(bi)然要求。各(ge)級(ji)黨委和(he)(he)(he)(he)政府(fu)要從奪取(qu)中國特色(se)社會(hui)主義(yi)新勝利的(de)(de)全局和(he)(he)(he)(he)戰(zhan)略(lve)高度,深刻(ke)認識構建(jian)(jian)(jian)和(he)(he)(he)(he)諧勞動(dong)(dong)關(guan)系的(de)(de)重大意義(yi),切實增(zeng)強責(ze)任感和(he)(he)(he)(he)使命感,把構建(jian)(jian)(jian)和(he)(he)(he)(he)諧勞動(dong)(dong)關(guan)系作為一(yi)項緊迫任務(wu),擺(bai)在(zai)更加突出的(de)(de)位置,采取(qu)有力(li)措施抓實抓好。
二(er)、構建和諧(xie)勞(lao)動關系的指導思想(xiang)、工作原則和目(mu)標任務
(一)指(zhi)導思想。全面貫(guan)(guan)徹黨的十(shi)八(ba)大(da)(da)(da)和(he)十(shi)八(ba)屆二中(zhong)、三中(zhong)、四中(zhong)全會精(jing)神(shen),以鄧小平(ping)理論、“三個代表”重要思想、科學(xue)發(fa)展(zhan)觀(guan)為(wei)指(zhi)導,深入貫(guan)(guan)徹習近平(ping)總(zong)書記系(xi)列重要講話精(jing)神(shen),貫(guan)(guan)徹落實(shi)黨中(zhong)央和(he)國務(wu)院的決策部署,堅持促進企(qi)業發(fa)展(zhan)、維護職工權益,堅持正確處理改革發(fa)展(zhan)穩(wen)定(ding)關系(xi),推動(dong)(dong)中(zhong)國特色和(he)諧勞動(dong)(dong)關系(xi)的建設和(he)發(fa)展(zhan),最大(da)(da)(da)限(xian)度增加勞動(dong)(dong)關系(xi)和(he)諧因素,最大(da)(da)(da)限(xian)度減(jian)少不(bu)和(he)諧因素,促進經濟持續健康發(fa)展(zhan)和(he)社(she)會和(he)諧穩(wen)定(ding),凝聚廣(guang)大(da)(da)(da)職工為(wei)實(shi)現(xian)“兩個一百年”奮(fen)斗目標、實(shi)現(xian)中(zhong)華民(min)族偉大(da)(da)(da)復興的中(zhong)國夢貢(gong)獻力量(liang)。
(二)工作原則
——堅持以人為本。把解(jie)決(jue)廣大(da)職工最(zui)關心、最(zui)直(zhi)接(jie)、最(zui)現實的利益問題,切實維護其根本權(quan)益,作為構建(jian)和諧勞動關系的根本出發(fa)點(dian)和落腳點(dian)。
——堅持依法(fa)(fa)(fa)(fa)構(gou)建。健全(quan)勞(lao)(lao)(lao)動保障法(fa)(fa)(fa)(fa)律法(fa)(fa)(fa)(fa)規,增強(qiang)企(qi)業依法(fa)(fa)(fa)(fa)用工(gong)意識,提高職工(gong)依法(fa)(fa)(fa)(fa)維權能力(li),加強(qiang)勞(lao)(lao)(lao)動保障執法(fa)(fa)(fa)(fa)監(jian)督和勞(lao)(lao)(lao)動糾紛調處,依法(fa)(fa)(fa)(fa)處理勞(lao)(lao)(lao)動關(guan)系矛盾,把勞(lao)(lao)(lao)動關(guan)系的建立、運(yun)行(xing)、監(jian)督、調處的全(quan)過程(cheng)納入法(fa)(fa)(fa)(fa)治化軌道(dao)。
——堅(jian)持共(gong)(gong)建共(gong)(gong)享。統籌處理(li)好促進企(qi)業發展和(he)維護職工權益(yi)的關系,調動(dong)勞(lao)動(dong)關系主(zhu)(zhu)體雙方的積極性、主(zhu)(zhu)動(dong)性,推(tui)動(dong)企(qi)業和(he)職工協商(shang)共(gong)(gong)事、機制共(gong)(gong)建、效(xiao)益(yi)共(gong)(gong)創、利益(yi)共(gong)(gong)享。
——堅持改革(ge)創新(xin)。從我國(guo)基本(ben)經(jing)濟(ji)(ji)(ji)制(zhi)(zhi)度出發,統籌考慮公有(you)制(zhi)(zhi)經(jing)濟(ji)(ji)(ji)、非公有(you)制(zhi)(zhi)經(jing)濟(ji)(ji)(ji)和(he)混合所(suo)有(you)制(zhi)(zhi)經(jing)濟(ji)(ji)(ji)的特點,不斷探究和(he)把(ba)握社會主義市場經(jing)濟(ji)(ji)(ji)條件下勞動關(guan)(guan)系(xi)的規律性,積極穩妥推進具(ju)有(you)中國(guo)特色的勞動關(guan)(guan)系(xi)工作(zuo)理論、體制(zhi)(zhi)、制(zhi)(zhi)度、機(ji)制(zhi)(zhi)和(he)方法創新(xin)。
(三)目(mu)標任務。加(jia)(jia)強調整勞(lao)動(dong)(dong)關系(xi)(xi)的(de)法律(lv)、體制(zhi)、制(zhi)度、機制(zhi)和能力建(jian)設,加(jia)(jia)快(kuai)(kuai)健(jian)全黨(dang)委領導、政府(fu)負責、社(she)會協同、企業和職工(gong)參與、法治(zhi)保障的(de)工(gong)作體制(zhi),加(jia)(jia)快(kuai)(kuai)形成源頭治(zhi)理(li)、動(dong)(dong)態管理(li)、應急處(chu)置相(xiang)結(jie)合的(de)工(gong)作機制(zhi),實(shi)現勞(lao)動(dong)(dong)用工(gong)更加(jia)(jia)規范,職工(gong)工(gong)資合理(li)增長,勞(lao)動(dong)(dong)條件不斷改善,職工(gong)安全健(jian)康得到切(qie)實(shi)保障,社(she)會保險全面覆蓋(gai),人文(wen)關懷日益加(jia)(jia)強,有(you)效預防和化解勞(lao)動(dong)(dong)關系(xi)(xi)矛(mao)盾(dun),建(jian)立規范有(you)序(xu)、公正合理(li)、互(hu)利共(gong)贏(ying)、和諧(xie)穩定的(de)勞(lao)動(dong)(dong)關系(xi)(xi)。
三、依(yi)法保障(zhang)職工基本權益(yi)
(四)切實(shi)(shi)保障職工(gong)(gong)取得勞動報(bao)酬的權利。完善并落實(shi)(shi)工(gong)(gong)資(zi)支(zhi)付規定,健全工(gong)(gong)資(zi)支(zhi)付監(jian)控、工(gong)(gong)資(zi)保證金和(he)欠(qian)薪應(ying)急周(zhou)轉金制度(du),探索(suo)建立欠(qian)薪保障金制度(du),落實(shi)(shi)清償欠(qian)薪的施(shi)工(gong)(gong)總(zong)承包企業負責(ze)制,依(yi)法懲處拒不支(zhi)付勞動報(bao)酬等違法犯罪行為,保障職工(gong)(gong)特(te)別是農民(min)工(gong)(gong)按時足額領到工(gong)(gong)資(zi)報(bao)酬。努力實(shi)(shi)現(xian)農民(min)工(gong)(gong)與城鎮(zhen)就業人員(yuan)同(tong)工(gong)(gong)同(tong)酬。
(五)切實保障職(zhi)(zhi)工(gong)休(xiu)(xiu)息(xi)休(xiu)(xiu)假的(de)權利。完(wan)善并落實國家(jia)(jia)關于職(zhi)(zhi)工(gong)工(gong)作時(shi)間、全國年(nian)節及紀念(nian)日(ri)假期、帶薪年(nian)休(xiu)(xiu)假等規定(ding)(ding)(ding),規范企業(ye)(ye)實行特殊工(gong)時(shi)制(zhi)度的(de)審批管理(li),督促企業(ye)(ye)依法安排(pai)職(zhi)(zhi)工(gong)休(xiu)(xiu)息(xi)休(xiu)(xiu)假。企業(ye)(ye)因生產經營需要(yao)安排(pai)職(zhi)(zhi)工(gong)延長工(gong)作時(shi)間的(de),應(ying)與工(gong)會和(he)職(zhi)(zhi)工(gong)協商(shang),并依法足額支付加班加點(dian)工(gong)資。加強勞(lao)動(dong)定(ding)(ding)(ding)額定(ding)(ding)(ding)員標(biao)準(zhun)化工(gong)作,推動(dong)勞(lao)動(dong)定(ding)(ding)(ding)額定(ding)(ding)(ding)員國家(jia)(jia)標(biao)準(zhun)、行業(ye)(ye)標(biao)準(zhun)的(de)制(zhi)定(ding)(ding)(ding)修訂,指導企業(ye)(ye)制(zhi)定(ding)(ding)(ding)實施(shi)科(ke)學(xue)合理(li)的(de)勞(lao)動(dong)定(ding)(ding)(ding)額定(ding)(ding)(ding)員標(biao)準(zhun),保障職(zhi)(zhi)工(gong)的(de)休(xiu)(xiu)息(xi)權利。
(六)切實(shi)(shi)保(bao)障(zhang)職(zhi)(zhi)(zhi)工(gong)獲得勞動(dong)(dong)(dong)安(an)全(quan)(quan)衛(wei)(wei)生保(bao)護(hu)的(de)權(quan)利。加(jia)強(qiang)勞動(dong)(dong)(dong)安(an)全(quan)(quan)衛(wei)(wei)生執法監督(du),督(du)促企業(ye)健全(quan)(quan)并落實(shi)(shi)勞動(dong)(dong)(dong)安(an)全(quan)(quan)衛(wei)(wei)生責任制,嚴格(ge)執行國(guo)家勞動(dong)(dong)(dong)安(an)全(quan)(quan)衛(wei)(wei)生保(bao)護(hu)標(biao)準(zhun),加(jia)大(da)安(an)全(quan)(quan)生產(chan)投(tou)入,強(qiang)化安(an)全(quan)(quan)生產(chan)和職(zhi)(zhi)(zhi)業(ye)衛(wei)(wei)生教育(yu)培訓(xun),提(ti)供符合(he)國(guo)家規(gui)定的(de)勞動(dong)(dong)(dong)安(an)全(quan)(quan)衛(wei)(wei)生條件和勞動(dong)(dong)(dong)保(bao)護(hu)用(yong)品,對(dui)從事有職(zhi)(zhi)(zhi)業(ye)危害(hai)作業(ye)的(de)職(zhi)(zhi)(zhi)工(gong)按照國(guo)家規(gui)定進行上崗前、在崗期間和離崗時的(de)職(zhi)(zhi)(zhi)業(ye)健康檢查,加(jia)強(qiang)女職(zhi)(zhi)(zhi)工(gong)和未成年工(gong)特殊(shu)勞動(dong)(dong)(dong)保(bao)護(hu),最大(da)限度地減少生產(chan)安(an)全(quan)(quan)事故和職(zhi)(zhi)(zhi)業(ye)病危害(hai)。
(七)切(qie)實(shi)保(bao)(bao)(bao)障職工(gong)(gong)享受社(she)(she)會(hui)(hui)(hui)保(bao)(bao)(bao)險和接(jie)受職業(ye)技能培訓的(de)(de)權利(li)。認真貫(guan)徹實(shi)施社(she)(she)會(hui)(hui)(hui)保(bao)(bao)(bao)險法(fa)(fa),繼(ji)(ji)續(xu)完善社(she)(she)會(hui)(hui)(hui)保(bao)(bao)(bao)險關(guan)(guan)系轉移接(jie)續(xu)辦法(fa)(fa),努力(li)實(shi)現(xian)社(she)(she)會(hui)(hui)(hui)保(bao)(bao)(bao)險全(quan)面覆(fu)蓋,落實(shi)廣大職工(gong)(gong)特(te)別是農民工(gong)(gong)和勞務(wu)派遣工(gong)(gong)的(de)(de)社(she)(she)會(hui)(hui)(hui)保(bao)(bao)(bao)險權益(yi)。督促企業(ye)依法(fa)(fa)為職工(gong)(gong)繳納各(ge)項社(she)(she)會(hui)(hui)(hui)保(bao)(bao)(bao)險費,鼓勵有條件(jian)的(de)(de)企業(ye)按照法(fa)(fa)律法(fa)(fa)規和有關(guan)(guan)規定(ding)為職工(gong)(gong)建立補充保(bao)(bao)(bao)險。引(yin)導職工(gong)(gong)自覺履(lv)行法(fa)(fa)定(ding)義務(wu),積極參加社(she)(she)會(hui)(hui)(hui)保(bao)(bao)(bao)險。加強(qiang)對職工(gong)(gong)的(de)(de)職業(ye)技能培訓,鼓勵職工(gong)(gong)參加學歷(li)教育和繼(ji)(ji)續(xu)教育,提高職工(gong)(gong)文化(hua)知識水(shui)平和技能水(shui)平。
四、健全勞動關(guan)系協調機(ji)制
(八(ba))全(quan)面實(shi)行(xing)(xing)(xing)(xing)勞(lao)(lao)動(dong)(dong)合(he)(he)同制(zhi)度(du)。貫(guan)徹(che)落實(shi)好勞(lao)(lao)動(dong)(dong)合(he)(he)同法(fa)等(deng)法(fa)律法(fa)規,加強(qiang)對企業(ye)(ye)實(shi)行(xing)(xing)(xing)(xing)勞(lao)(lao)動(dong)(dong)合(he)(he)同制(zhi)度(du)的(de)監(jian)督、指(zhi)導和服務(wu),在(zai)用(yong)工(gong)季節性強(qiang)、職工(gong)流(liu)動(dong)(dong)性大的(de)行(xing)(xing)(xing)(xing)業(ye)(ye)推(tui)(tui)廣簡易勞(lao)(lao)動(dong)(dong)合(he)(he)同示范文本,依法(fa)規范勞(lao)(lao)動(dong)(dong)合(he)(he)同訂立(li)、履行(xing)(xing)(xing)(xing)、變更(geng)、解(jie)除、終止等(deng)行(xing)(xing)(xing)(xing)為(wei),切(qie)實(shi)提高勞(lao)(lao)動(dong)(dong)合(he)(he)同簽訂率(lv)和履行(xing)(xing)(xing)(xing)質(zhi)量。依法(fa)加強(qiang)對勞(lao)(lao)務(wu)派遣的(de)監(jian)管,規范非全(quan)日制(zhi)、勞(lao)(lao)務(wu)承攬(lan)、勞(lao)(lao)務(wu)外包用(yong)工(gong)和企業(ye)(ye)裁(cai)員(yuan)行(xing)(xing)(xing)(xing)為(wei)。指(zhi)導企業(ye)(ye)建立(li)健全(quan)勞(lao)(lao)動(dong)(dong)規章制(zhi)度(du),提升勞(lao)(lao)動(dong)(dong)用(yong)工(gong)管理水(shui)平。全(quan)面推(tui)(tui)進(jin)勞(lao)(lao)動(dong)(dong)用(yong)工(gong)信息申報備案制(zhi)度(du)建設,加強(qiang)對企業(ye)(ye)勞(lao)(lao)動(dong)(dong)用(yong)工(gong)的(de)動(dong)(dong)態管理。
(九)推(tui)行集(ji)體(ti)(ti)(ti)(ti)協(xie)商和(he)集(ji)體(ti)(ti)(ti)(ti)合(he)同(tong)(tong)制(zhi)度(du)。以非公有制(zhi)企業(ye)為重點對象(xiang),依法(fa)推(tui)進工資(zi)集(ji)體(ti)(ti)(ti)(ti)協(xie)商,不斷擴(kuo)大覆(fu)蓋面、增強(qiang)實效性,形成反映人力(li)資(zi)源市場供求關系和(he)企業(ye)經濟效益的(de)工資(zi)決定機制(zhi)和(he)正常增長機制(zhi)。完善(shan)工資(zi)指導線制(zhi)度(du),加(jia)快建立統一規范的(de)企業(ye)薪酬(chou)調(diao)查和(he)信息發布(bu)制(zhi)度(du),為開展工資(zi)集(ji)體(ti)(ti)(ti)(ti)協(xie)商提供參考(kao)。推(tui)動企業(ye)與職(zhi)(zhi)工就工作條(tiao)件、勞動定額、女職(zhi)(zhi)工特殊保(bao)護等(deng)開展集(ji)體(ti)(ti)(ti)(ti)協(xie)商,訂(ding)立集(ji)體(ti)(ti)(ti)(ti)合(he)同(tong)(tong)。加(jia)強(qiang)集(ji)體(ti)(ti)(ti)(ti)協(xie)商代表能(neng)力(li)建設,提高(gao)協(xie)商水平。加(jia)強(qiang)對集(ji)體(ti)(ti)(ti)(ti)協(xie)商過程的(de)指導,督促企業(ye)和(he)職(zhi)(zhi)工認真履行集(ji)體(ti)(ti)(ti)(ti)合(he)同(tong)(tong)。
(十)健(jian)全協(xie)調(diao)勞動(dong)(dong)關(guan)系(xi)三(san)方機制(zhi)(zhi)(zhi)。完善協(xie)調(diao)勞動(dong)(dong)關(guan)系(xi)三(san)方機制(zhi)(zhi)(zhi)組(zu)織(zhi)體系(xi),建(jian)(jian)立健(jian)全由人力(li)資(zi)源社會保障(zhang)部門會同工(gong)會和企業聯合會、工(gong)商業聯合會等(deng)企業代表組(zu)織(zhi)組(zu)成(cheng)的三(san)方機制(zhi)(zhi)(zhi),根據實(shi)際(ji)需要(yao)(yao)推動(dong)(dong)工(gong)業園區(qu)、鄉鎮(街道(dao))和產業系(xi)統建(jian)(jian)立三(san)方機制(zhi)(zhi)(zhi)。加強和創新三(san)方機制(zhi)(zhi)(zhi)組(zu)織(zhi)建(jian)(jian)設(she),建(jian)(jian)立健(jian)全協(xie)調(diao)勞動(dong)(dong)關(guan)系(xi)三(san)方委(wei)(wei)員會,由同級政府(fu)領導擔任委(wei)(wei)員會主(zhu)任。完善三(san)方機制(zhi)(zhi)(zhi)職能,健(jian)全工(gong)作制(zhi)(zhi)(zhi)度,充分發揮政府(fu)、工(gong)會和企業代表組(zu)織(zhi)共同研究解決有(you)關(guan)勞動(dong)(dong)關(guan)系(xi)重大問題的重要(yao)(yao)作用。
五、加強(qiang)企業民主(zhu)管理制(zhi)度(du)建設
(十一)健全企(qi)業(ye)(ye)(ye)(ye)民(min)(min)主(zhu)管理(li)制度(du)。完(wan)善以(yi)職(zhi)工(gong)(gong)代(dai)表大(da)(da)會(hui)(hui)(hui)為基(ji)本形式的企(qi)業(ye)(ye)(ye)(ye)民(min)(min)主(zhu)管理(li)制度(du),豐富(fu)職(zhi)工(gong)(gong)民(min)(min)主(zhu)參(can)(can)與(yu)形式,暢通職(zhi)工(gong)(gong)民(min)(min)主(zhu)參(can)(can)與(yu)渠道,依法保障(zhang)職(zhi)工(gong)(gong)的知情權(quan)、參(can)(can)與(yu)權(quan)、表達權(quan)、監督權(quan)。推進企(qi)業(ye)(ye)(ye)(ye)普(pu)遍建(jian)立職(zhi)工(gong)(gong)代(dai)表大(da)(da)會(hui)(hui)(hui),認(ren)真落實職(zhi)工(gong)(gong)代(dai)表大(da)(da)會(hui)(hui)(hui)職(zhi)權(quan),充分發揮職(zhi)工(gong)(gong)代(dai)表大(da)(da)會(hui)(hui)(hui)在企(qi)業(ye)(ye)(ye)(ye)發展重(zhong)大(da)(da)決策和涉及職(zhi)工(gong)(gong)切身利益等重(zhong)大(da)(da)事項(xiang)上的重(zhong)要作用。針對(dui)不同所有(you)制企(qi)業(ye)(ye)(ye)(ye),探(tan)索符合(he)各自特點(dian)的職(zhi)工(gong)(gong)代(dai)表大(da)(da)會(hui)(hui)(hui)形式、權(quan)限和職(zhi)能。在中小(xiao)企(qi)業(ye)(ye)(ye)(ye)集中的地方,可以(yi)建(jian)立區域性、行業(ye)(ye)(ye)(ye)性職(zhi)工(gong)(gong)代(dai)表大(da)(da)會(hui)(hui)(hui)。

(十三)推行職(zhi)工(gong)(gong)(gong)董(dong)事(shi)(shi)、職(zhi)工(gong)(gong)(gong)監(jian)事(shi)(shi)制(zhi)(zhi)度。按(an)照公司(si)法(fa)規(gui)定(ding)(ding),在公司(si)制(zhi)(zhi)企業建立職(zhi)工(gong)(gong)(gong)董(dong)事(shi)(shi)、職(zhi)工(gong)(gong)(gong)監(jian)事(shi)(shi)制(zhi)(zhi)度。依法(fa)規(gui)范職(zhi)工(gong)(gong)(gong)董(dong)事(shi)(shi)、職(zhi)工(gong)(gong)(gong)監(jian)事(shi)(shi)履職(zhi)規(gui)則。在董(dong)事(shi)(shi)會、監(jian)事(shi)(shi)會研(yan)究決(jue)定(ding)(ding)公司(si)重大問題時,職(zhi)工(gong)(gong)(gong)董(dong)事(shi)(shi)、職(zhi)工(gong)(gong)(gong)監(jian)事(shi)(shi)應充分發表意見,反映(ying)職(zhi)工(gong)(gong)(gong)合(he)理訴求(qiu),維護職(zhi)工(gong)(gong)(gong)和公司(si)合(he)法(fa)權益。
六、健全勞動關系矛(mao)盾調處機制

(十六)完善(shan)勞(lao)動(dong)(dong)關(guan)(guan)系群(qun)體(ti)(ti)性(xing)事(shi)件預防和(he)應(ying)急處(chu)置(zhi)機制。加強(qiang)對勞(lao)動(dong)(dong)關(guan)(guan)系形勢的分析研判,建立勞(lao)動(dong)(dong)關(guan)(guan)系群(qun)體(ti)(ti)性(xing)糾(jiu)紛的經常性(xing)排查和(he)動(dong)(dong)態監測(ce)預警制度,及時(shi)發現和(he)積極解(jie)決(jue)勞(lao)動(dong)(dong)關(guan)(guan)系領(ling)域的苗(miao)頭性(xing)、傾向性(xing)問(wen)題,有效防范(fan)群(qun)體(ti)(ti)性(xing)事(shi)件。完善(shan)應(ying)急預案(an),明確分級響應(ying)、處(chu)置(zhi)程序和(he)處(chu)置(zhi)措施。健(jian)全黨委領(ling)導(dao)下的政府負責,有關(guan)(guan)部門和(he)工會、企業(ye)代表組織共同參與的群(qun)體(ti)(ti)性(xing)事(shi)件應(ying)急聯動(dong)(dong)處(chu)置(zhi)機制,形成(cheng)快(kuai)速反(fan)應(ying)和(he)處(chu)置(zhi)工作合(he)力,督促指導(dao)企業(ye)落實主體(ti)(ti)責任(ren),及時(shi)妥善(shan)處(chu)置(zhi)群(qun)體(ti)(ti)性(xing)事(shi)件。
七、營(ying)造構建和諧勞動關系(xi)的良(liang)好環(huan)境

(十八)加強(qiang)對(dui)(dui)職(zhi)工(gong)的(de)(de)(de)人(ren)文關懷。培育(yu)富有特色的(de)(de)(de)企(qi)業(ye)精神(shen)和(he)健(jian)康向(xiang)上的(de)(de)(de)香蕉视频(pin)下(xia)载,為職(zhi)工(gong)構建共同的(de)(de)(de)精神(shen)家(jia)園。注重職(zhi)工(gong)的(de)(de)(de)精神(shen)需求和(he)心理(li)健(jian)康,及(ji)時了解掌握職(zhi)工(gong)思想動態,有針對(dui)(dui)性地做(zuo)好(hao)思想引(yin)導(dao)和(he)心理(li)疏導(dao)工(gong)作,建立心理(li)危機干預預警機制。加強(qiang)企(qi)業(ye)文體娛樂設(she)施建設(she),積極組織職(zhi)工(gong)開(kai)展喜(xi)聞樂見、豐富多(duo)彩的(de)(de)(de)文化(hua)體育(yu)活動,豐富職(zhi)工(gong)文化(hua)生活。拓寬(kuan)職(zhi)工(gong)的(de)(de)(de)發展渠(qu)道(dao),拓展職(zhi)業(ye)發展空間。
(十九)教育引(yin)(yin)導(dao)企(qi)業經營者積極履行社(she)(she)會(hui)(hui)責(ze)任。加(jia)強廣大(da)企(qi)業經營者的(de)(de)(de)思想政(zheng)治教育,引(yin)(yin)導(dao)其(qi)踐行社(she)(she)會(hui)(hui)主義核心價(jia)值(zhi)觀,牢固樹立愛國(guo)、敬業、誠(cheng)信、守法(fa)(fa)、奉獻精神(shen),切實(shi)承擔(dan)報效國(guo)家、服務社(she)(she)會(hui)(hui)、造福職(zhi)工(gong)(gong)的(de)(de)(de)社(she)(she)會(hui)(hui)責(ze)任。教育引(yin)(yin)導(dao)企(qi)業經營者自覺關(guan)心愛護職(zhi)工(gong)(gong),努力改善職(zhi)工(gong)(gong)的(de)(de)(de)工(gong)(gong)作、學習(xi)和生活條件,幫助他(ta)們排憂解(jie)難,加(jia)大(da)對困難職(zhi)工(gong)(gong)的(de)(de)(de)幫扶力度。建立符合(he)我國(guo)國(guo)情的(de)(de)(de)企(qi)業社(she)(she)會(hui)(hui)責(ze)任標準體(ti)系和評價(jia)體(ti)系,營造鼓勵企(qi)業履行社(she)(she)會(hui)(hui)責(ze)任的(de)(de)(de)環境。加(jia)強對企(qi)業經營者尤其(qi)是中小(xiao)企(qi)業經營管(guan)理人員(yuan)的(de)(de)(de)勞動保障法(fa)(fa)律(lv)法(fa)(fa)規教育培訓,提(ti)高他(ta)們的(de)(de)(de)依法(fa)(fa)用工(gong)(gong)意識,引(yin)(yin)導(dao)他(ta)們自覺保障職(zhi)工(gong)(gong)合(he)法(fa)(fa)權(quan)益。
(二十)優化企(qi)(qi)(qi)業發(fa)展(zhan)環境。加強和(he)改進政(zheng)府的(de)管理服務,減(jian)(jian)少和(he)規范(fan)涉(she)企(qi)(qi)(qi)行政(zheng)審批(pi)事項(xiang),提(ti)高審批(pi)事項(xiang)的(de)工(gong)作效率(lv),激發(fa)市場主體創造(zao)活力(li)(li)。加大對中小企(qi)(qi)(qi)業政(zheng)策扶持力(li)(li)度,特別是(shi)推(tui)進扶持小微企(qi)(qi)(qi)業發(fa)展(zhan)的(de)各項(xiang)政(zheng)策落(luo)實落(luo)地(di),進一步減(jian)(jian)輕(qing)企(qi)(qi)(qi)業負擔。加強技術(shu)支(zhi)持,引導企(qi)(qi)(qi)業主動轉型升(sheng)級(ji),緊緊依靠科技進步、職工(gong)素質提(ti)升(sheng)和(he)管理創新,不(bu)斷提(ti)升(sheng)競(jing)爭力(li)(li)。通過促進企(qi)(qi)(qi)業發(fa)展(zhan),為構建和(he)諧勞動關系創造(zao)物質條(tiao)件。
(二十一)加強構建和諧(xie)勞(lao)動關系的法(fa)(fa)(fa)(fa)治保(bao)(bao)障(zhang)(zhang)。進(jin)(jin)一步(bu)完善勞(lao)動法(fa)(fa)(fa)(fa)、勞(lao)動合同法(fa)(fa)(fa)(fa)、勞(lao)動爭議(yi)調解仲裁法(fa)(fa)(fa)(fa)、社會保(bao)(bao)險法(fa)(fa)(fa)(fa)、職(zhi)業病防治法(fa)(fa)(fa)(fa)等法(fa)(fa)(fa)(fa)律(lv)的配套(tao)法(fa)(fa)(fa)(fa)規(gui)(gui)、規(gui)(gui)章和政策,加快完善基本勞(lao)動標準、集(ji)體(ti)協商(shang)和集(ji)體(ti)合同、企業工資、勞(lao)動保(bao)(bao)障(zhang)(zhang)監察、企業民主管(guan)理、協調勞(lao)動關系三(san)方機制等方面(mian)的制度(du),逐步(bu)健全勞(lao)動保(bao)(bao)障(zhang)(zhang)法(fa)(fa)(fa)(fa)律(lv)法(fa)(fa)(fa)(fa)規(gui)(gui)體(ti)系。深(shen)入(ru)開(kai)展法(fa)(fa)(fa)(fa)律(lv)法(fa)(fa)(fa)(fa)規(gui)(gui)宣傳教育,加強行政執(zhi)法(fa)(fa)(fa)(fa)和法(fa)(fa)(fa)(fa)律(lv)監督,促進(jin)(jin)各項勞(lao)動保(bao)(bao)障(zhang)(zhang)法(fa)(fa)(fa)(fa)律(lv)法(fa)(fa)(fa)(fa)規(gui)(gui)貫徹實施。
八、加(jia)強組(zu)織領導和(he)統(tong)籌協(xie)調(diao)
