《勞務派(pai)遣暫行規定(ding)》(以(yi)下簡(jian)稱《暫行規定(ding)》)經(jing)人力資(zi)源(yuan)和社會保障部第(di)21次(ci)部務會議(yi)審議(yi)通過,將于2014年3月1日(ri)起(qi)正式施行。日(ri)前,記者就有關(guan)問題(ti)專(zhuan)訪(fang)了全國總工會書記處書記郭軍。
記者:《暫行規(gui)定(ding)》備受社會關注,有贊成有反對。請問郭書記,規(gui)定(ding)出(chu)臺的(de)背景(jing)是什么?
郭軍(jun):《暫行規(gui)定(ding)(ding)》出(chu)臺的(de)(de)大背景(jing)是(shi)貫(guan)徹落實(shi)依法治(zhi)國基本國策,一方面使市(shi)場在勞動力(li)資源的(de)(de)配(pei)置上起(qi)決定(ding)(ding)性(xing)作用,同時更好地發揮政(zheng)府的(de)(de)規(gui)范、監督作用。另一方面是(shi)為(wei)了(le)貫(guan)徹黨的(de)(de)群(qun)眾(zhong)路線,實(shi)現社會公(gong)平(ping)正義,切實(shi)維護職(zhi)工特別是(shi)勞務派遣職(zhi)工的(de)(de)合法權益。具體(ti)而言,是(shi)按照全國人大常委會《關于(yu)修改的(de)(de)決定(ding)(ding)》要求,為(wei)更好地執行《勞動合同法》相關規(gui)定(ding)(ding)而制定(ding)(ding)施(shi)行的(de)(de)。
勞(lao)務(wu)(wu)派(pai)遣(qian)是《勞(lao)動(dong)合同(tong)法(fa)》規(gui)(gui)范(fan)的(de)重要(yao)內容。全國(guo)人大常委(wei)會在2008年、2011年進(jin)行的(de)兩次(ci)《勞(lao)動(dong)合同(tong)法(fa)》執法(fa)檢(jian)查中發現,勞(lao)務(wu)(wu)派(pai)遣(qian)用(yong)工(gong)領域存在突出問題亟待解決,如(ru)用(yong)工(gong)單位超出“三性”崗位范(fan)圍、在主(zhu)營業務(wu)(wu)崗位長(chang)期使(shi)用(yong)勞(lao)務(wu)(wu)派(pai)遣(qian);被(bei)派(pai)遣(qian)勞(lao)動(dong)者(zhe)與勞(lao)動(dong)合同(tong)制職工(gong)同(tong)工(gong)不同(tong)酬;勞(lao)務(wu)(wu)派(pai)遣(qian)機(ji)構不規(gui)(gui)范(fan),非法(fa)派(pai)遣(qian)嚴重等(deng)等(deng),建議通過修改(gai)完善法(fa)律有(you)關(guan)規(gui)(gui)定(ding),進(jin)一步規(gui)(gui)范(fan)勞(lao)務(wu)(wu)派(pai)遣(qian)。2012年12月,全國(guo)人大常委(wei)會通過了《關(guan)于修改(gai)的(de)決定(ding)》。按(an)照該決定(ding)要(yao)求,人力資源和社(she)會保障部制定(ding)了《勞(lao)務(wu)(wu)派(pai)遣(qian)暫行規(gui)(gui)定(ding)》。
記者:《暫行規定》的主要內容(rong)是什么?
郭(guo)軍:《暫(zan)行規(gui)定(ding)(ding)》共7章(zhang),29條,主要對以下幾(ji)方面的(de)(de)(de)重(zhong)要內(nei)(nei)容(rong)做(zuo)了規(gui)定(ding)(ding):一(yi)是(shi)明確(que)勞(lao)(lao)務派(pai)(pai)遣(qian)(qian)用(yong)(yong)(yong)(yong)工(gong)(gong)(gong)(gong)(gong)比(bi)例。規(gui)定(ding)(ding)用(yong)(yong)(yong)(yong)工(gong)(gong)(gong)(gong)(gong)單(dan)位使用(yong)(yong)(yong)(yong)被派(pai)(pai)遣(qian)(qian)勞(lao)(lao)動者(zhe)數量不(bu)得超過(guo)其(qi)用(yong)(yong)(yong)(yong)工(gong)(gong)(gong)(gong)(gong)總量的(de)(de)(de)10%。二是(shi)規(gui)定(ding)(ding)輔(fu)助(zhu)性(xing)崗位的(de)(de)(de)確(que)定(ding)(ding)程序。用(yong)(yong)(yong)(yong)工(gong)(gong)(gong)(gong)(gong)單(dan)位確(que)定(ding)(ding)可使用(yong)(yong)(yong)(yong)被派(pai)(pai)遣(qian)(qian)勞(lao)(lao)動者(zhe)的(de)(de)(de)輔(fu)助(zhu)性(xing)崗位,應當(dang)經(jing)職工(gong)(gong)(gong)(gong)(gong)代表(biao)大(da)會(hui)或(huo)者(zhe)全(quan)體(ti)職工(gong)(gong)(gong)(gong)(gong)討論,提出方案(an)和意見,與工(gong)(gong)(gong)(gong)(gong)會(hui)或(huo)者(zhe)職工(gong)(gong)(gong)(gong)(gong)代表(biao)平等協(xie)商確(que)定(ding)(ding),并(bing)在用(yong)(yong)(yong)(yong)工(gong)(gong)(gong)(gong)(gong)單(dan)位內(nei)(nei)公示。三(san)是(shi)明確(que)跨地(di)區派(pai)(pai)遣(qian)(qian)勞(lao)(lao)動者(zhe)的(de)(de)(de),應當(dang)在用(yong)(yong)(yong)(yong)工(gong)(gong)(gong)(gong)(gong)單(dan)位所在地(di)為(wei)被派(pai)(pai)遣(qian)(qian)勞(lao)(lao)動者(zhe)參加社會(hui)保險。四是(shi)禁止“假外包真派(pai)(pai)遣(qian)(qian)”。明確(que)規(gui)定(ding)(ding)用(yong)(yong)(yong)(yong)人單(dan)位以承攬、外包等名義,按(an)勞(lao)(lao)務派(pai)(pai)遣(qian)(qian)用(yong)(yong)(yong)(yong)工(gong)(gong)(gong)(gong)(gong)形式使用(yong)(yong)(yong)(yong)勞(lao)(lao)動者(zhe)的(de)(de)(de),依法(fa)(fa)嚴肅(su)處理(li)。五是(shi)設置兩年過(guo)渡期。此外,還對勞(lao)(lao)動合(he)同(tong)(tong)、勞(lao)(lao)務派(pai)(pai)遣(qian)(qian)協(xie)議的(de)(de)(de)訂(ding)立(li)和履行,勞(lao)(lao)動合(he)同(tong)(tong)的(de)(de)(de)解除(chu)和終止,法(fa)(fa)律責任等做(zuo)了具體(ti)規(gui)定(ding)(ding)。
記(ji)者:據了解,各級(ji)工(gong)(gong)(gong)會(hui)為(wei)規范勞務派遣(qian)用工(gong)(gong)(gong)行為(wei),保障勞務派遣(qian)工(gong)(gong)(gong)權益,在堅(jian)持推動相關法規政(zheng)策的(de)頒布和實施中(zhong)做出了不懈努力。請問全總在參與《暫行規定》制(zhi)定過程中(zhong)做了哪(na)些工(gong)(gong)(gong)作?
郭(guo)軍:全總積極(ji)主(zhu)(zhu)(zhu)動(dong)參與《暫行(xing)(xing)(xing)(xing)規定》起草工(gong)(gong)(gong)作(zuo)(zuo),所做工(gong)(gong)(gong)作(zuo)(zuo)主(zhu)(zhu)(zhu)要有以(yi)下幾項(xiang):首先是(shi)在《勞動(dong)合同法》修改后開展廣(guang)泛(fan)(fan)深入(ru)的調查(cha)研究(jiu),積極(ji)主(zhu)(zhu)(zhu)動(dong)地(di)向人(ren)(ren)力資(zi)源(yuan)和(he)(he)社會(hui)(hui)保(bao)障部(bu)提(ti)出(chu)意見(jian)建議。二是(shi)參加人(ren)(ren)力資(zi)源(yuan)和(he)(he)社會(hui)(hui)保(bao)障部(bu)主(zhu)(zhu)(zhu)持召(zhao)開的系列(lie)(lie)座談會(hui)(hui)、論(lun)證(zheng)會(hui)(hui),明確提(ti)出(chu)和(he)(he)堅持工(gong)(gong)(gong)會(hui)(hui)的意見(jian)主(zhu)(zhu)(zhu)張(zhang)。三是(shi)全總辦公廳專(zhuan)(zhuan)(zhuan)門下發(fa)《關于配合做好公開征求意見(jian)工(gong)(gong)(gong)作(zuo)(zuo)的通知》,廣(guang)泛(fan)(fan)動(dong)員工(gong)(gong)(gong)會(hui)(hui)干部(bu)和(he)(he)廣(guang)大(da)職工(gong)(gong)(gong)參與公開征求意見(jian)活動(dong)。四是(shi)組(zu)織全總法律(lv)顧問(wen)委(wei)員會(hui)(hui)委(wei)員和(he)(he)專(zhuan)(zhuan)(zhuan)家(jia)學者對(dui)《暫行(xing)(xing)(xing)(xing)規定》草案(an)進(jin)行(xing)(xing)(xing)(xing)專(zhuan)(zhuan)(zhuan)題(ti)研究(jiu)。五是(shi)參加全國人(ren)(ren)大(da)法工(gong)(gong)(gong)委(wei)、人(ren)(ren)力資(zi)源(yuan)和(he)(he)社會(hui)(hui)保(bao)障部(bu)開展的勞務(wu)(wu)派(pai)(pai)遣聯合調研,并就勞務(wu)(wu)派(pai)(pai)遣用工(gong)(gong)(gong)比例偏高的電(dian)信等行(xing)(xing)(xing)(xing)業(ye)進(jin)行(xing)(xing)(xing)(xing)專(zhuan)(zhuan)(zhuan)題(ti)調研,廣(guang)泛(fan)(fan)聽取各方的意見(jian)建議。六是(shi)以(yi)“《勞務(wu)(wu)派(pai)(pai)遣若干規定(草案(an))》熱點聚焦”為主(zhu)(zhu)(zhu)題(ti),在工(gong)(gong)(gong)人(ren)(ren)日(ri)報(bao)組(zu)織系列(lie)(lie)報(bao)道和(he)(he)專(zhuan)(zhuan)(zhuan)題(ti)討論(lun),深入(ru)剖析勞務(wu)(wu)派(pai)(pai)遣領域中的熱點難點問(wen)題(ti),闡述和(he)(he)論(lun)證(zheng)工(gong)(gong)(gong)會(hui)(hui)主(zhu)(zhu)(zhu)張(zhang)。
人力資源和社(she)(she)會保障部(bu)高度(du)重(zhong)視全總代表職工(gong)(gong)所反映的意(yi)見和建議,如“三性”崗位勞務派遣用工(gong)(gong)比例不得超(chao)出10%、進一步保障跨地區被(bei)派遣勞動者社(she)(she)會保險權益等重(zhong)大意(yi)見建議在《暫行規定》中都給予了(le)積(ji)極的回(hui)應和明確的肯定。

郭(guo)軍:《暫行(xing)規定》是貫徹落(luo)實(shi)《勞動合同法》的一項重(zhong)要(yao)舉措。其頒布實(shi)施,對改變用工理(li)念和方式(shi),進(jin)一步(bu)規范(fan)勞務派遣用工行(xing)為,維護被派遣勞動者的合法權益,促進(jin)企業持續健(jian)康發展(zhan),構(gou)建(jian)和諧穩定勞動關系具有重(zhong)要(yao)意義。
