【廉政教育】新形勢下“車輪腐敗”的表現及對策思考

認(ren)真貫徹黨(dang)中央和中央紀委持(chi)續深入落實中央八項規定(ding)精神的(de)部(bu)署要求,近(jin)期,我們立足咸寧并(bing)參考全國各地的(de)典型案例,對(dui)公車改革后(hou)(hou)“車輪腐(fu)敗”新(xin)變異問題進(jin)(jin)行了(le)研究,初步概括(kuo)出新(xin)形勢下“車輪腐(fu)敗”五大(da)類(lei)負面清單(dan),并(bing)對(dui)背(bei)后(hou)(hou)的(de)深層次原(yuan)因進(jin)(jin)行分析,提出對(dui)策建議。

2019年端午期(qi)間,湖北咸寧紀委(wei)監委(wei)干部在公安部門通(tong)過(guo)“天眼”系統排(pai)查(cha)違規使用公車問題(ti)線索(suo)。

負面清單

清單一:公(gong)(gong)(gong)車(che)(che)私(si)(si)(si)用(yong)趨隱蔽。以(yi)咸(xian)寧為例,黨(dang)的(de)十(shi)九大以(yi)來公(gong)(gong)(gong)車(che)(che)私(si)(si)(si)用(yong)占“車(che)(che)輪腐敗”問題(ti)60%以(yi)上,且呈(cheng)現出隱蔽化新特點(dian)。一是(shi)變通私(si)(si)(si)用(yong)。如有(you)的(de)單位(wei)對干部開綠燈,將公(gong)(gong)(gong)務(wu)用(yong)車(che)(che)當作(zuo)接送(song)上下班(ban)的(de)通勤車(che)(che)使(shi)用(yong)。二是(shi)租車(che)(che)私(si)(si)(si)用(yong)。有(you)的(de)用(yong)公(gong)(gong)(gong)款(kuan)租賃車(che)(che)輛(liang)逃避監(jian)督。三是(shi)公(gong)(gong)(gong)私(si)(si)(si)混用(yong)。如打著辦(ban)公(gong)(gong)(gong)事名義辦(ban)私(si)(si)(si)事,企圖蒙混過關。四是(shi)擅駕私(si)(si)(si)用(yong)。有(you)的(de)單位(wei)對公(gong)(gong)(gong)務(wu)用(yong)車(che)(che)長期(qi)疏于管理,致使(shi)公(gong)(gong)(gong)車(che)(che)長期(qi)被駕駛員私(si)(si)(si)開私(si)(si)(si)用(yong)。

清單二:私(si)車(che)(che)公(gong)(gong)(gong)(gong)養(yang)名(ming)堂多(duo)。公(gong)(gong)(gong)(gong)務用車(che)(che)制(zhi)度改(gai)革后,私(si)車(che)(che)公(gong)(gong)(gong)(gong)養(yang)問(wen)(wen)題(ti)逐漸凸顯(xian)。首先是私(si)油(you)公(gong)(gong)(gong)(gong)供問(wen)(wen)題(ti)。此類(lei)問(wen)(wen)題(ti)目前查處較多(duo),有的(de)(de)是借“私(si)車(che)(che)公(gong)(gong)(gong)(gong)用”之名(ming),報銷(xiao)私(si)車(che)(che)產(chan)生的(de)(de)相關費用;有的(de)(de)則是利(li)用保管公(gong)(gong)(gong)(gong)務加油(you)卡的(de)(de)便(bian)利(li),為私(si)家(jia)車(che)(che)加油(you)。其次是私(si)車(che)(che)公(gong)(gong)(gong)(gong)修(xiu)(xiu)問(wen)(wen)題(ti)。如以私(si)車(che)(che)冒充(chong)公(gong)(gong)(gong)(gong)車(che)(che),到單位定點(dian)維修(xiu)(xiu)廠維修(xiu)(xiu),費用由單位結(jie)算(suan)。還有私(si)票(piao)公(gong)(gong)(gong)(gong)報問(wen)(wen)題(ti)。如將(jiang)私(si)車(che)(che)產(chan)生的(de)(de)保險費、維修(xiu)(xiu)費、年檢費等發票(piao)拿(na)到公(gong)(gong)(gong)(gong)家(jia)報賬。

清(qing)單(dan)三:超(chao)標(biao)(biao)配(pei)備耍手(shou)(shou)段。高(gao)壓之下(xia),有的(de)干部仍然存在特權思想,變換手(shou)(shou)法(fa)超(chao)標(biao)(biao)配(pei)備用車。有的(de)在發票(piao)(piao)上動手(shou)(shou)腳,通過“技(ji)術”處理試圖掩(yan)蓋超(chao)標(biao)(biao)配(pei)備事實。如咸寧市(shi)中醫(yi)醫(yi)院原黨委書(shu)記(ji)劉某超(chao)標(biao)(biao)配(pei)備公(gong)車,將(jiang)超(chao)標(biao)(biao)準部分(fen)變更為購置車輛精品配(pei)飾名(ming)目,分(fen)2張開具(ju)發票(piao)(piao)結算。有的(de)在指(zhi)標(biao)(biao)上花心思,通過“轉(zhuan)嫁”方式試圖為違(wei)規(gui)配(pei)備披上合理外衣。如山東(dong)省聊城市(shi)東(dong)元資產經(jing)營有限公(gong)司黨委書(shu)記(ji)、董事長王某在未辦理車控審批手(shou)(shou)續情況下(xia),擅自決定以下(xia)屬公(gong)司名(ming)義違(wei)規(gui)購買三輛公(gong)務用車,其中超(chao)標(biao)(biao)準購置一(yi)輛別克商務車。

清單(dan)(dan)四:借(jie)用(yong)占用(yong)享特權。面對公(gong)車(che)改革后的(de)用(yong)車(che)荒問題,有(you)(you)單(dan)(dan)位(wei)把手伸向了下(xia)屬(shu)單(dan)(dan)位(wei)或管(guan)理服務對象(xiang)。有(you)(you)的(de)借(jie)用(yong)下(xia)屬(shu)單(dan)(dan)位(wei)車(che)輛,還(huan)將產生的(de)燃油費(fei)、維修費(fei)等在下(xia)屬(shu)單(dan)(dan)位(wei)報(bao)銷(xiao)。有(you)(you)的(de)找管(guan)理服務對象(xiang)借(jie)車(che)用(yong)且久借(jie)不還(huan),甚至(zhi)為規避監督不用(yong)公(gong)車(che)借(jie)私車(che)。如咸寧市通山縣人民法院審(shen)判委員(yuan)會委員(yuan)、立案庭審(shen)判員(yuan)徐某長期借(jie)用(yong)案件當(dang)事人轎車(che)供個人使用(yong)。

清單(dan)五:油(you)卡(ka)(ka)消費搞任性。有(you)的人貪欲膨脹,打公務(wu)加油(you)卡(ka)(ka)的主意,變著花樣撈好處。有(you)的單(dan)位(wei)負責人特意辦理(li)(li)加油(you)主、副(fu)卡(ka)(ka),明修棧道暗度(du)陳倉“揩油(you)”。有(you)的利用公務(wu)油(you)卡(ka)(ka)管(guan)理(li)(li)漏洞,用油(you)卡(ka)(ka)購(gou)買(mai)個人消費物品。如(ru)遼寧省遼陽市(shi)文圣區礦產品銷售計(ji)量服務(wu)中(zhong)心(xin)副(fu)主任劉某,利用單(dan)位(wei)加油(you)卡(ka)(ka)在(zai)加油(you)站便利店購(gou)買(mai)香(xiang)煙、燃(ran)油(you)寶(bao)等18次。

原因探究

上述五(wu)類公車(che)使用“負面(mian)(mian)清(qing)單”,有的看似新表現,實則還(huan)是老問題(ti)。在正風肅紀的高壓(ya)態(tai)勢下,改(gai)頭換面(mian)(mian)的“車(che)輪(lun)腐敗(bai)”不時冒頭,其中(zhong)(zhong)既有少數(shu)黨員干部思想認識(shi)層面(mian)(mian)的主(zhu)觀原(yuan)因,也反映出個別地方、單位在公車(che)管(guan)理(li)工作中(zhong)(zhong)的漏洞(dong)。

一(yi)是特權思想(xiang)與僥(jiao)幸心(xin)理(li)(li)并存。從咸寧(ning)查(cha)處的(de)(de)26起違(wei)(wei)規(gui)配備使用公務用車違(wei)(wei)紀問(wen)題主觀動機和認(ren)錯(cuo)態(tai)度分析,明知故犯或從眾心(xin)態(tai)的(de)(de)有(you)(you)(you)23起占(zhan)88.46%,不知法紀僅(jin)有(you)(you)(you)3起占(zhan)11.54%。可以(yi)看出,有(you)(you)(you)的(de)(de)人吃公家飯(fan)就(jiu)想(xiang)占(zhan)公家便宜(yi),對(dui)侵占(zhan)公共利益不以(yi)為(wei)然;有(you)(you)(you)的(de)(de)黨員干部紀律(lv)意識(shi)淡(dan)漠,對(dui)中央八項規(gui)定精(jing)神(shen)和有(you)(you)(you)關規(gui)定置若罔聞(wen);有(you)(you)(you)的(de)(de)明知自己的(de)(de)行為(wei)違(wei)(wei)規(gui)違(wei)(wei)紀,卻仍(reng)存僥(jiao)幸心(xin)理(li)(li),覺(jue)得反“四風”、查(cha)違(wei)(wei)規(gui)用車都(dou)抓了(le)這(zhe)么久(jiu),風頭應該過去了(le),只(zhi)要再小心(xin)一(yi)點(dian)、再隱蔽一(yi)點(dian)、再高明一(yi)點(dian)就(jiu)不會被發現,等等。

二是(shi)隱(yin)形(xing)變異(yi)(yi)與監(jian)督(du)手段少并存(cun)。隨(sui)著作(zuo)風建設步(bu)步(bu)深入,公(gong)車腐敗隱(yin)蔽性越(yue)來越(yue)強,給監(jian)督(du)帶來實(shi)際困(kun)難。各(ge)地雖然主動運用大數據監(jian)督(du)、群眾監(jian)督(du)等方式開展綜合(he)施治,但實(shi)踐中(zhong),像發(fa)現問(wen)題(ti)線索效(xiao)果較(jiao)好的(de)數據監(jian)督(du)就(jiu)面臨(lin)著需要靠人(ren)工從數十萬條(tiao)基礎(chu)數據中(zhong)逐條(tiao)篩查比對,精準(zhun)性不高、時效(xiao)性不強等問(wen)題(ti),如何(he)提升(sheng)隱(yin)形(xing)變異(yi)(yi)問(wen)題(ti)發(fa)現率,仍缺少有(you)力技(ji)術支撐。

三是制(zhi)(zhi)(zhi)度(du)短板與責任缺(que)失并存(cun)。日(ri)常監督(du)中(zhong),公(gong)(gong)車(che)(che)管(guan)(guan)理(li)使用(yong)(yong)(yong)仍存(cun)在(zai)制(zhi)(zhi)(zhi)度(du)設(she)計層面的(de)“盲區(qu)”。如(ru)應(ying)急用(yong)(yong)(yong)車(che)(che)管(guan)(guan)理(li)使用(yong)(yong)(yong)、異地交流任職干(gan)部用(yong)(yong)(yong)車(che)(che)等配套(tao)細(xi)化不(bu)夠,鄉(xiang)鎮等基層公(gong)(gong)務(wu)用(yong)(yong)(yong)車(che)(che)保障機制(zhi)(zhi)(zhi)研究不(bu)夠等。出現“車(che)(che)輪腐(fu)敗”,很大程度(du)上還(huan)與管(guan)(guan)理(li)粗放密(mi)切相關。如(ru)有(you)(you)(you)(you)的(de)單位(wei)假期車(che)(che)輛封存(cun)、公(gong)(gong)車(che)(che)定點(dian)停放、公(gong)(gong)車(che)(che)使用(yong)(yong)(yong)審批報告(gao)等制(zhi)(zhi)(zhi)度(du)執(zhi)行不(bu)嚴(yan)。有(you)(you)(you)(you)的(de)單位(wei)公(gong)(gong)車(che)(che)改(gai)革不(bu)到(dao)位(wei),執(zhi)行公(gong)(gong)務(wu)用(yong)(yong)(yong)車(che)(che)使用(yong)(yong)(yong)管(guan)(guan)理(li)制(zhi)(zhi)(zhi)度(du)存(cun)在(zai)打折(zhe)扣、搞變(bian)通現象。有(you)(you)(you)(you)的(de)公(gong)(gong)車(che)(che)管(guan)(guan)理(li)缺(que)乏(fa)規范性(xing),加油卡使用(yong)(yong)(yong)、公(gong)(gong)車(che)(che)經費(fei)報銷等管(guan)(guan)理(li)混亂(luan),出現專卡不(bu)專用(yong)(yong)(yong)、報銷隨意(yi)性(xing)大等問題(ti)。再加上一些地方、單位(wei)落實(shi)全面從(cong)嚴(yan)治黨(dang)主體責任不(bu)力,對(dui)公(gong)(gong)車(che)(che)管(guan)(guan)理(li)缺(que)乏(fa)有(you)(you)(you)(you)效監督(du),對(dui)苗頭性(xing)、傾向性(xing)問題(ti)不(bu)能及時制(zhi)(zhi)(zhi)止和糾正,為“車(che)(che)輪腐(fu)敗”提供了機會。

四是(shi)(shi)配套措(cuo)施滯后與現(xian)實(shi)(shi)需求并存。按照有關規定,黨政機關應當推(tui)進公(gong)(gong)務(wu)(wu)用(yong)(yong)車(che)(che)(che)服(fu)(fu)(fu)務(wu)(wu)平臺(tai)(tai)(tai)(tai)建設,將各類公(gong)(gong)務(wu)(wu)用(yong)(yong)車(che)(che)(che)納入平臺(tai)(tai)(tai)(tai)集中(zhong)管理(li),采用(yong)(yong)信息(xi)化手段(duan)統籌(chou)調度、高(gao)(gao)(gao)效使用(yong)(yong),鼓勵通過社會化專業(ye)機構提高(gao)(gao)(gao)平臺(tai)(tai)(tai)(tai)管理(li)運行效率。但(dan)實(shi)(shi)際中(zhong),現(xian)階(jie)段(duan)公(gong)(gong)務(wu)(wu)用(yong)(yong)車(che)(che)(che)服(fu)(fu)(fu)務(wu)(wu)平臺(tai)(tai)(tai)(tai)無論從(cong)規模還是(shi)(shi)服(fu)(fu)(fu)務(wu)(wu)上(shang),均難以滿足各單位用(yong)(yong)車(che)(che)(che)需求。以咸寧為例,公(gong)(gong)務(wu)(wu)用(yong)(yong)車(che)(che)(che)服(fu)(fu)(fu)務(wu)(wu)平臺(tai)(tai)(tai)(tai)尚處于(yu)“保守”運營階(jie)段(duan),最多僅(jin)能提供(gong)二十多臺(tai)(tai)(tai)(tai)公(gong)(gong)車(che)(che)(che)服(fu)(fu)(fu)務(wu)(wu),一般僅(jin)用(yong)(yong)于(yu)保障重要公(gong)(gong)務(wu)(wu)活(huo)動出(chu)行。目前,很多單位面臨“公(gong)(gong)車(che)(che)(che)平臺(tai)(tai)(tai)(tai)叫車(che)(che)(che)難、社會租(zu)賃價格(ge)高(gao)(gao)(gao)、私車(che)(che)(che)公(gong)(gong)用(yong)(yong)有風險(xian)”等難題,公(gong)(gong)務(wu)(wu)出(chu)行得(de)不到保障,于(yu)是(shi)(shi)開(kai)始(shi)另找門路。

對策建議

針對負(fu)面(mian)清單所列(lie)問題,可考慮從人、技、物、制四個(ge)方面(mian)下功夫(fu),構建全(quan)方位、立體化監督(du)格局。

一是強化(hua)(hua)“人防”。各級黨組(zu)織(zhi)要扛起責(ze)任(ren),加強公(gong)(gong)務用(yong)(yong)車(che)管(guan)理(li)(li)規范化(hua)(hua)、實效化(hua)(hua)。公(gong)(gong)車(che)監(jian)(jian)管(guan)職能(neng)部(bu)門(men)應加快(kuai)建立(li)全方(fang)位、立(li)體(ti)化(hua)(hua)監(jian)(jian)督機(ji)制,機(ji)關(guan)事(shi)務管(guan)理(li)(li)部(bu)門(men)定期運用(yong)(yong)多部(bu)門(men)數(shu)據(ju)關(guan)聯比對分析快(kuai)速挖掘出隱(yin)藏的問題(ti)線索(suo);財政、審計(ji)部(bu)門(men)將公(gong)(gong)務用(yong)(yong)車(che)燃油費使用(yong)(yong)情(qing)況(kuang)作(zuo)為(wei)“三公(gong)(gong)”經費審計(ji)、監(jian)(jian)督的重要內容;各級紀檢監(jian)(jian)察(cha)機(ji)關(guan)建立(li)公(gong)(gong)務用(yong)(yong)車(che)重點(dian)問題(ti)線索(suo)快(kuai)查(cha)快(kuai)結機(ji)制,強化(hua)(hua)追責(ze)問責(ze)力度,在嚴肅處理(li)(li)直(zhi)接責(ze)任(ren)人的同時,要根據(ju)情(qing)形嚴肅追究相關(guan)黨組(zu)織(zhi)及其負責(ze)人的主體(ti)責(ze)任(ren)和監(jian)(jian)督責(ze)任(ren),并點(dian)名(ming)道姓通(tong)報(bao)曝光。

二(er)是強(qiang)化“技防”。將糾治(zhi)“四(si)風”數(shu)據監(jian)(jian)(jian)(jian)(jian)督平(ping)(ping)臺(tai)建設(she)與紀(ji)檢監(jian)(jian)(jian)(jian)(jian)察機關信息化建設(she)結合,高(gao)標準建成(cheng)糾治(zhi)“四(si)風”數(shu)據監(jian)(jian)(jian)(jian)(jian)督網,實(shi)現“四(si)風”數(shu)據收集、比對、分析、發現、查(cha)處(chu)智能化運(yun)作、高(gao)效(xiao)率監(jian)(jian)(jian)(jian)(jian)督。搭建大平(ping)(ping)臺(tai)的(de)同時,建成(cheng)公(gong)(gong)務(wu)(wu)用(yong)(yong)車(che)監(jian)(jian)(jian)(jian)(jian)督子平(ping)(ping)臺(tai),打通(tong)公(gong)(gong)安、機關事(shi)務(wu)(wu)管理、石油(you)(you)公(gong)(gong)司、紀(ji)檢監(jian)(jian)(jian)(jian)(jian)察等相關部(bu)門對公(gong)(gong)務(wu)(wu)用(yong)(yong)車(che)運(yun)行數(shu)據的(de)平(ping)(ping)臺(tai)壁(bi)壘,通(tong)過對“公(gong)(gong)務(wu)(wu)用(yong)(yong)車(che)正常休假日加油(you)(you)、公(gong)(gong)務(wu)(wu)用(yong)(yong)車(che)每次加油(you)(you)使(shi)用(yong)(yong)量不合理、每天有效(xiao)加油(you)(you)量超過車(che)輛總數(shu)、公(gong)(gong)務(wu)(wu)油(you)(you)卡(ka)消費其他物品(pin)”等重點問題定向(xiang)比對查(cha)找、預警識別(bie),提升監(jian)(jian)(jian)(jian)(jian)督質效(xiao)。

三是強化“物防”。加快(kuai)建設區域(yu)性公(gong)務(wu)用車(che)(che)服(fu)務(wu)平(ping)臺,將(jiang)(jiang)機要、應(ying)急、調研(yan)接(jie)待(dai)、跨部門(men)(men)綜合執法等車(che)(che)輛納入平(ping)臺集中統(tong)一管(guan)理(li),對公(gong)務(wu)出行(xing)實現高效保障,同時實現公(gong)車(che)(che)運(yun)行(xing)全過程監控、運(yun)維(wei)費(fei)用全流程記錄,公(gong)車(che)(che)管(guan)理(li)信息系統(tong)一鍵匯總分析,逐步實現公(gong)車(che)(che)管(guan)理(li)“一張網”。用車(che)(che)單位、公(gong)車(che)(che)主管(guan)部門(men)(men)、紀檢監察(cha)機關、審(shen)計部門(men)(men)、財政部門(men)(men)都可以將(jiang)(jiang)平(ping)臺作為公(gong)務(wu)用車(che)(che)使(shi)用管(guan)理(li)及監督(du)的有效工(gong)具。

四是強化(hua)“制(zhi)(zhi)防”。注重提升制(zhi)(zhi)度(du)實(shi)效性(xing),綜合分析“負面清(qing)單”的(de)具體情形、認定標準和處理(li)(li)方式等(deng),出臺嚴格規(gui)范的(de)責任(ren)追(zhui)究實(shi)施辦法。注重提升制(zhi)(zhi)度(du)適用性(xing),完(wan)善“三公(gong)”經費管(guan)(guan)理(li)(li)、公(gong)務(wu)用車使用管(guan)(guan)理(li)(li)等(deng)制(zhi)(zhi)度(du)規(gui)定,梳(shu)理(li)(li)解決(jue)應(ying)急用車管(guan)(guan)理(li)(li)使用、異地交(jiao)流任(ren)職干部用車、鄉鎮等(deng)基層(ceng)公(gong)務(wu)用車保(bao)障機制(zhi)(zhi)等(deng)操作(zuo)層(ceng)面的(de)問題。注重提升管(guan)(guan)理(li)(li)規(gui)范性(xing),探索完(wan)善公(gong)車管(guan)(guan)理(li)(li)標準體系,推進公(gong)務(wu)用車管(guan)(guan)理(li)(li)科學化(hua)、精(jing)細化(hua)。(湖北(bei)省咸(xian)寧市委常委、市紀委書記(ji)、市監委代主(zhu)任(ren) 朱慶(qing)剛)
