第四十九條 對涉嫌(xian)嚴重違紀或(huo)者(zhe)職(zhi)務違法、職(zhi)務犯(fan)罪問題的審(shen)查(cha)調查(cha)，監督執紀人員未(wei)經批準并(bing)辦理相關手續，不得將被審(shen)查(cha)調查(cha)人或(huo)者(zhe)其他重要(yao)的談話(hua)、詢問對象(xiang)帶離規(gui)定(ding)的談話(hua)場(chang)所，不得在未(wei)配置監控設(she)備(bei)的場(chang)所進行審(shen)查(cha)調查(cha)談話(hua)或(huo)者(zhe)其他重要(yao)的談話(hua)、詢問，不得在談話(hua)期間關閉錄音錄像(xiang)設(she)備(bei)。

本條是關(guan)于紀檢監察機關(guan)審查調查談話場(chang)所(suo)及(ji)相關(guan)要(yao)求的規(gui)定。

本條(tiao)針對(dui)涉嫌嚴重(zhong)違紀或(huo)者職(zhi)務違法(fa)、職(zhi)務犯(fan)罪問(wen)題(ti)(ti)的(de)審(shen)查(cha)(cha)(cha)(cha)(cha)調(diao)(diao)查(cha)(cha)(cha)(cha)(cha)談(tan)(tan)(tan)(tan)話(hua)(hua)(hua)風(feng)險規(gui)(gui)(gui)(gui)定(ding)了(le)“三個不(bu)得”的(de)要(yao)(yao)求。本條(tiao)規(gui)(gui)(gui)(gui)定(ding)與《規(gui)(gui)(gui)(gui)則》第四(si)十八條(tiao)規(gui)(gui)(gui)(gui)定(ding)的(de)“重(zhong)要(yao)(yao)取(qu)證(zheng)(zheng)工作”相呼(hu)應，明(ming)確(que)了(le)與重(zhong)要(yao)(yao)的(de)談(tan)(tan)(tan)(tan)話(hua)(hua)(hua)、詢問(wen)對(dui)象的(de)談(tan)(tan)(tan)(tan)話(hua)(hua)(hua)等(deng)(deng)重(zhong)要(yao)(yao)取(qu)證(zheng)(zheng)工作也(ye)(ye)應當全(quan)程同(tong)(tong)步錄(lu)(lu)音錄(lu)(lu)像，留(liu)存備查(cha)(cha)(cha)(cha)(cha)。這(zhe)里(li)的(de)“其他重(zhong)要(yao)(yao)的(de)談(tan)(tan)(tan)(tan)話(hua)(hua)(hua)、詢問(wen)對(dui)象”，主要(yao)(yao)是(shi)(shi)指重(zhong)要(yao)(yao)涉案(an)人(ren)員(yuan)、證(zheng)(zheng)人(ren)等(deng)(deng)。“重(zhong)要(yao)(yao)的(de)談(tan)(tan)(tan)(tan)話(hua)(hua)(hua)、詢問(wen)”，主要(yao)(yao)是(shi)(shi)指對(dui)于(yu)證(zheng)(zheng)實(shi)(shi)被(bei)審(shen)查(cha)(cha)(cha)(cha)(cha)調(diao)(diao)查(cha)(cha)(cha)(cha)(cha)人(ren)存在涉嫌嚴重(zhong)違紀或(huo)者職(zhi)務違法(fa)、職(zhi)務犯(fan)罪問(wen)題(ti)(ti)具有(you)關鍵性作用的(de)談(tan)(tan)(tan)(tan)話(hua)(hua)(hua)、詢問(wen)等(deng)(deng)。除了(le)全(quan)面的(de)談(tan)(tan)(tan)(tan)話(hua)(hua)(hua)、詢問(wen)外，專門(men)對(dui)某一重(zhong)要(yao)(yao)事(shi)實(shi)(shi)、情節(jie)進行(xing)核實(shi)(shi)的(de)談(tan)(tan)(tan)(tan)話(hua)(hua)(hua)或(huo)詢問(wen)，也(ye)(ye)需要(yao)(yao)有(you)錄(lu)(lu)音錄(lu)(lu)像加以(yi)固定(ding)。例如，共(gong)同(tong)(tong)受(shou)(shou)賄(hui)中，被(bei)審(shen)查(cha)(cha)(cha)(cha)(cha)調(diao)(diao)查(cha)(cha)(cha)(cha)(cha)人(ren)是(shi)(shi)否明(ming)知特定(ding)關系人(ren)收受(shou)(shou)好處是(shi)(shi)能否認定(ding)被(bei)審(shen)查(cha)(cha)(cha)(cha)(cha)調(diao)(diao)查(cha)(cha)(cha)(cha)(cha)人(ren)構(gou)成共(gong)同(tong)(tong)受(shou)(shou)賄(hui)的(de)關鍵，就這(zhe)一問(wen)題(ti)(ti)對(dui)相關證(zheng)(zheng)人(ren)的(de)詢問(wen)就是(shi)(shi)“重(zhong)要(yao)(yao)的(de)詢問(wen)”。本條(tiao)規(gui)(gui)(gui)(gui)定(ding)的(de)“三個不(bu)得”要(yao)(yao)求，是(shi)(shi)為(wei)(wei)了(le)防止談(tan)(tan)(tan)(tan)話(hua)(hua)(hua)等(deng)(deng)脫離于(yu)組(zu)織監督控制范圍，出現(xian)安全(quan)風(feng)險，也(ye)(ye)是(shi)(shi)為(wei)(wei)了(le)防止出現(xian)審(shen)查(cha)(cha)(cha)(cha)(cha)調(diao)(diao)查(cha)(cha)(cha)(cha)(cha)人(ren)員(yuan)濫用職(zhi)權、非法(fa)取(qu)證(zheng)(zheng)的(de)問(wen)題(ti)(ti)。這(zhe)里(li)規(gui)(gui)(gui)(gui)定(ding)的(de)談(tan)(tan)(tan)(tan)話(hua)(hua)(hua)場所，不(bu)局限于(yu)留(liu)置場所，也(ye)(ye)適(shi)用于(yu)非留(liu)置的(de)談(tan)(tan)(tan)(tan)話(hua)(hua)(hua)場所。
